Honorable Speaker, my colleagues, ladies and
gentlemen:
Good afternoon or almost, good evening.
First of all, Mr. Speaker, please allow me, on behalf
of all the Members of the Committee on the Welfare of
Children, to thank McDenver N. Macaraeg who sang
our national anthem and delivered the Doxology today.
The child was trained by Mr. Richard T. Barbadillo.
Denver is a Grade VI pupil of the Pres. Corazon
Cojuangco Aquino Elementary School, our next-door
neighbor here at Batasan Complex, and headed by their
Principal, Dr. Elvira Dumalo.
It is October once again, and it is Children’s Month.
Presidential Proclamation No. 267, of then-President
Fidel Valdez Ramos, declared the month of October of
every year as National Children’s month. This Act was
to emphasize the importance of the child’s role within
the Filipino family, the school, the community and in
nation building.
Section 13, Article II of the Philippine Constitution
recognizes the vital role of the youth in nation building.
It stipulates the promotion and protection of the
physical, moral, spiritual, intellectual and social well-
being of the children. It mandates, to inculcate in the
youth, patriotism and nationalism, and encourage the
involvement in public and civic affairs.
For the year 2014, our partner in the Executive
department which is the Department of Social Welfare
and Development chose the theme: BATA KASALI
KA…IKAW AY MAHALAGA. This theme is anchored
upon the right of a child to participation and freedom
of expression as embodied in the Constitution or in the
Convention on the Rights of a Child.
Article 12 of the Convention provides and I quote:
1. States Parties shall assure to the child
who is capable of forming his or her own views
the right to express those views freely in all
matters affecting the child, the views of the
child being given due weight in accordance
with the age and maturity of the child.
2. For this purpose, the child shall in
particular be provided the opportunity to
be heard in any judicial and administrative
proceedings affecting the child, either directly,
or through a representative or an appropriate
body, in a manner consistent with the procedural
rules of national law.
This goes hand in hand with Article 13 of the same
Convention which provides, and again I quote:
1. The child shall have the right to freedom
of expression; this right shall include freedom to
seek, receive and impart information and ideas of
all kinds, regardless of frontiers, either orally, in
writing or in print, in the form of art, or through
any other media of the child’s choice.
Mr. Speaker, honorable Members of this Congress,
40 years ago, on December 10, 1974, 25 years ahead of
the Convention on the Rights of the Child, Philippine
Presidential Decree No. 603 was signed into law. Section
3 of this decree stipulated the rights of a Filipino child.
The law does not stop on asserting the rights of a child.
It goes beyond by also stipulating the responsibilities
of a child in Section 4. As early as then, Mr. Speaker,
the Filipino child was already deemed capable of being
vested with rights and accompanying responsibilities.
Mr. Speaker, that was 40 years ago.
Mr. Speaker, dear colleagues, as crafted 40 years
ago, Section 3, item 12 of Presidential Decree 603
states that:
Every child has the right to grow up as a free
individual, in an atmosphere of peace, understanding,
tolerance, and universal brotherhood, and with the
determination to contribute his share in the building
of a better world.
MONDAY, OCTOBER 20, 2014 Mr. Speaker, this last phrase “to contribute his share
in the building of a better world” is a clear mandate for
child participation. Several researches which found
that children want to participate in decision making,
especially in matters affecting them have already been
conducted.
Mr. Speaker, this Chamber has not been
remiss in crafting laws for the protection of our
children. This time, we dream of crafting these
laws in consultation with them. It was during the
Fourteenth Congress when this House made a
categorical statement of being child friendly by
creating the standing Committee on Welfare of
Children which I now chair.
Mr. Speaker, after being in existence for the
past two Congresses, may we again assert the
importance we give to children by allowing their
views to be heard. May I again state my previous
request for this Chamber to recognize the rights
of a child to participation in the processes in this
House. May I again ask that we include in our
very own House Rules a provision which allows
children to be consulted during public hearings and
committee meetings on matters directly affecting
them.
We, in the Committee on Welfare of Children
have invited children to our committee meetings
in the past when we were deliberating on the
bills on promotion of positive discipline. The
committee was also instrumental in crafting a bill
on disaster risk reduction on children. Upon the
initiative of Save the Children, an international
movement which is our partner in promoting
child participation, the Committee co-sponsored
workshops with several legislative staff of childadvocate Congressmen and staff of Congressmen
from “Yolanda-torn” districts. We are proud
to say, Mr. Speaker, that the views of children
victims of typhoon “Yolanda” were considered
in the crafting of a bill now filed by one of our
child-advocate legislators, Rep. Susan A. Yap, in
House Bill No. 5062. At the proper time, we will
invite children to our public hearing to consult
them again on the Bill.
Mr. Speaker, we want to open the idea to
other House chairpersons who also deliberate on
matters directly affecting children, that children
may indeed be consulted during Committee
hearings in this House. As I emphasized last
year, Mr. Speaker, dear colleagues, listening
to children does not mean adults following
what children want. It only means we take into
consideration what they want before we, adults,
decide to achieve the common good. It does not
feel right, Mr. Speaker, for us to be assuming that
we know what is best for the children without

looking at things from their point of view. After
all, Mr. Speaker, as it is written in 2 Chronicles
34:1-3, Josiah was only eight years old when he began
to reign, and he reigned for 31 years in Jerusalem.
This child Josiah did what was right in the eyes of
the Lord. We are not asking our children to reign as
Josiah did, all we want is for us here in the House of
Representatives, to listen to what they have to say
on laws directly affecting them.
Mr. Speaker, august Members of this Chamber,
this Children’s Month celebration is not only the
month when we are reminded of our commitment to
protect our Filipino children. We do not stop at being
reminded, Mr. Speaker. This is the month when we take
action to recognize their vulnerability and the need to
address it.
Lastly, Mr. Speaker, pending in the plenary are
two measures seeking the protection of the Filipino
child: the bill protecting children in situations of
armed conflict, reported out as House Bill No.
4557, filed way back in June; and the other bill on
the promotion of positive discipline for children
which was reported out as House Bill No. 4907
last August 27, 2014. Both await plenary action.
These are both committee priorities which I ask
you to support by approving it both on Second and
Third Readings.
With this, Mr. Speaker, thank you in advance for
your unending support to the Filipino child. Thank you,
Mr. Speaker.

PRIVILEGE SPEECH OF REP. HICAP
REP. HICAP. Maraming salamat, Mr. Speaker. Mga
kapwa Mambabatas, magandang hapon.
Nagpapasalamat ang Kinatawang ito sa panahong
inilaan upang magpahayag ng mahahalagang usaping
kasalukuyang kinakaharap ng Pilipinong masang
anakpawis. Lalo na sa araw na ito na bahagi ng
Linggo ng Magbubukid sa isang taunang pag-alala sa
Presidential Decree No. 27, o ang huwad na reporma
sa lupa ng nagdaang diktadurang Marcos. Ang mga
issue ngayon ng patuloy na kawalan ng lupa ng mga
magsasaka, malawakang pangangamkam ng lupa,
lupang sakahan at tirahan, lumalalang kahirapan at
kagutuman, at paglabag sa karapatang tao ay nararapat
lamang na maitampok, marinig at mapagtuunan ng
masusing pansin.
G. Ispiker, mga kapwa Mambabatas, minarapat
ng Kinatawang ito sa panahong naka-recess ang
session ng Kamara nitong nakaraang mga linggo na
magtungo sa ilang komunidad ng anakpawis sa labas
ng Kamaynilaan. Sa mga lugar na iyon, nagkaroon ako
ng pagkakataon na muling masiyasat ang samu’t sari
at tumitinding banta sa kabuhayan, tirahan at mismong
buhay ng mga magsasaka at mangingisda nating mga
kababayan.
Sa Laiya, San Juan, Batangas, halimbawa, kasama
ang mga lider ng Pambansang Lakas ng Kilusang
Mamamalakaya o PAMALAKAYA at ng Samahan ng
Magbubukid ng Batangas o SAMBAT, napag-alaman ng
Kinatawang ito na humigit-kumulang sa 600 pamilyang
mangingisda at magsasaka ang nawalan ng tirahan at
kabuhayan sa marahas na demolisyon noong ika-3 ng
Hulyo, 2014 na isinagawa ng 2,000 pulis. Mga 20 bus
ng mga demolition crew. Ang puwersahang nagpalayas
sa bisa ng isang court order mula sa Rosario Regional
Trial Court ay pakana ng korporasyon sa turismo gaya
ng Laiya Development Corporation.
At this juncture, Deputy Speaker Aggabao
relinquished the Chair to Rep. Mar-Len Abigail S.
Binay.
Ito nga ba ang sadyang kapalit ng pagde-develop
sa Laiya upang maging Boracay ng Luzon? Ang
paglapastangan sa karapatan sa paninirahan at
kabuhayan ng ikatlong henerasyon ng mga magsasaka
at mangingisda roon. Gng. Ispiker, mga kapwa
Mambabatas, mariin at galit na kinokondena ng
mangingisdang Kinatawang ito ang ganitong kalupitan
sa ating mga kababayan.
Kaninang umaga naman ay tinanggap ng Kinatawang
ito, kasama ng iba pang Kinatawan mula sa Makabayan
Coalition ang inisyal na report ng katatapos pa lamang
na Peasant Women’s International Fact-Finding Mission
na inilunsad sa Barangay Mascap sa Rodriguez, Rizal
at sa Hacienda Luisita sa Tarlac sa pangunguna ng
Amihan, isang pambansang pederasyon ng kababaihan
sa kanayunan, at ng Unyon ng mga Manggagawa sa
Agrikultura o UMA.
Mme. Speaker, ayon sa kanila, ang mga magsasaka
sa Mascap o ang 1,644 ektaryang tinatawag nilang
Hacienda Doronila-Araneta ay nangangamba ngayon na
mapaalis mula sa lupang matagal na nilang binubungkal.
Nito lamang Pebrero 2014, nagdesisyon ang Korte
Suprema pabor sa pamilya Araneta na nangangahulugan
ng pagkakansela ng halos 1,000 Certificate of Land
Transfer o CLT, Emancipation Patent o EP at Certificate
of Land Ownership Award o CLOA na dati nang inisyu
ng pamahalaan sa mga magsasaka.
Sa Hacienda Luisita, samantala, iniulat ng
nasabing fact-finding mission ang hindi pa rin tumitigil
na pagpapalayas, pangha-harass, pananakit sa mga
manggagawang bukid, paninira ng kanilang mga
tanim, pagsasampa laban sa kanila ng patong patong
at gawa-gawang kasong criminal ang itinuturong
pangunahing may kagagawan. Gng. Ispiker, sa mga
ito ay ang Tarlac Development Corporation o Tadeco,
Central Azucarera de Tarlac o CAT, Luisita Realty
Corporation o LRC at iba pang korporasyong pag-aari
ng pamilya Cojuangco-Aquino. Sa pamamagitan ng
paggamit ng kani-kanilang mga armadong tauhan,
kasama na ang lokal na mga unit ng pulis at militar,
sangkot din dito ang tinatawag na aryendador o
financier sa tubuhan at maging ang lokal na mga
opisyal na mismo ng Department of Agrarian Reform.
Wala pa man ang bagong ulat na ito, isa po ang
Kinatawang ito sa aktuwal na makapagpapatunay
sa karahasan at panggigipit sa Hacienda Luisita.
Kung maaalala ninyo, Gng. Ispiker, mga kapuwa
Mambabatas, isa na ako sa dinampot at ikinulong
sa Tarlac City noong Setyembre 2013 sa gitna ng
isang naunang fact-finding mission para alamin ang
tumitinding tensiyon sa Hacienda Luisita kaugnay ng
sinasabing huwad na pamamahagi ng DAR doon.
Nitong Sabado lamang, kasama ang organisador ng
Kilusang Magbubukid ng Pilipinas o KMP, nagtungo
ako sa San Jose del Monte, Bulacan. Nakausap ko doon
ang ilang mga libong magsasaka na mapapalayas sa
mahigit 300 ektaryang sakahan na masasagasaan ng
napipintong pagtayo ng istasyon at iba pang instalasyon
ng proyektong MRT-7.
At this juncture, Rep. Binay relinquished the Chair
to Deputy Speaker Giorgidi B. Aggabao.
G. Ispiker, mga kapuwa ko Mambabatas, ang mga
ito ay hindi simpleng hiwa-hiwalay na pambihirang
mga pangyayari. Buo ang paniniwala ng Kinatawang
ito na ang nabanggit na mga kaso ay bahagi ng
isang pangkalahatang kaayusan, isang tiyak na
pambansang padron na patuloy na magpapasakit sa
MONDAY, OCTOBER 20, 2014 mga magbubukid bunsod ng hindi angkop, palyado,
kontra mamamayan at makadayuhang mga patakaran
at programa ng pamahalaan. Sa katunayan, daandaang magsasaka ang kasalukuyang nasa labas,
nananawagan ng pagsasabatas ng House Bill No. 252
o ang Genuine Agrarian Reform Bill o ang GARB
at dumudulog ukol sa kanilang mga partikular na
isyu. Gayundin, ang mga kababaihang magbubukid
ay suportado ang mga agrarian reform and human
rights international advocates.
Nakatayo pa rin ang malawak na hacienda sa
buong bansa, maging ang mga plantasyong kontrolado
ng dayuhan. Samantala, kaliwa’t kanan naman ang
pagbawi mula sa mga magsasaka ng mga CLOA, CLT
at EP, bagay na hindi makatarungan at nagtatanggal
sa kanila ng karapatang bungkalin ang mga lupaing
dapat naipamahagi na. Malinaw itong patunay sa
kabiguan ng pamahalaan na makapaghatid ng tunay
na hustisyang panlipunan sa kabila ng napakahaba
na, napakagastos pang programa nito sa repormang
agraryo. Habang nakakalusot ang libo-libong ektaryang
lupaing agrikultural ng malalaki at makapangyarihang
haciendero, ang mga lupaing sinasabing saklaw ng
distribution, umaayon naman sa tuso at malupit na
modus na “bigay-bawi.”
Kauganay nito, ang Kinatawang ito ay naghahapag
na dinggin na ang resolusyon ko para imbestigahan ng
Committee on Agrarian Reform ang nakakaalarmang
kanselasyon ng mga CLOA, EP at CLT ng mga
magsasakang benepisyaryo lalo na sa mga lalawigan
ng Batangas, Leyte, Bulacan, Cebu, Laguna, Capiz,
Pampanga at Nueva Ecija. Ito ay ang House Resolution
No. 914 na kasalukuyang nakapila ngayon sa Committee
on Rules.
G. Ispiker, mga kapwa Mambabatas, laganap sa
buong bansa ang iba’t ibang porma ng kumbersiyon ng
mga lupaing pangsakahan para gamitin ng iilang lokal at
dayuhang entidad sa real estate, agro-industry, economic
zone, ecotourism, malakihang pagmimina at iba pa. Ang
mga proyektong ito ay ibayong nagkakait ng lupa at
kabuhayan sa mga magbubukid na nagsasapeligro sa
pambansang produksiyon ng pagkain at pagdudulot
ng permanenteng pinsala sa kalikasan. Ang direksiyon
ng pamahalaan tungo sa todo-largang liberalisasyon
ng ekonomiya sa ilalim ng tinatawag na ASEAN
Integration ay tiyak na magpapalala sa ganitong
sitwasyon. Ang pagtulak mula sa kasalukuyang 30
porsyento hanggang 40 porsyentong taripa sa iniaangkat
ng produktong agrikultural pababa sa limang prosyento
sa mga susunod na taon ay mistulang sentensiya ng
kamatayan sa naghihingalo na ngang lokal na sektor
ng agrikultura.
Ngayon pa lamang, ramdam na ramdam na,
hindi lamang ng mga nagtatanim ng palay kundi
ng publiko sa kalakhan, ang dagok na hatid ng tila
walangsagkang importasyon ng bigas sa pangunguna

ng Department of Agriculture at ng kakambal nitong
Office of the Presidential Assistant for Food Security
and Agricultural Modernization. Sa pagkakataong
ito, nais ulitin ng Kinatawang ito ang sinabi ng
magiting na dating Kinatawan ng ANAKPAWIS na
si Cong. Rafael Mariano. Ayon kay Ka Paeng, hindi
ang masamang panahon o bagyo ang totoong kalaban
ng lokal na industriya ng bigas kundi ang mismong
masamang patakaran ng gobyerno. Gayundin, sa pagarangkada ng liberalisasyon, partikular ng tinatawag
na ecotourism liberalization, tinatayang darami pa
ang kaso ng pangangamkam ng lupa sa pamamagitan
ng kumbersiyon ng mga pamayanang pangsakahan
at pangisdaan. Libu-libo pang mamamayan, kung
gayon, ang malalagay sa parehong sitwasyon ng
mga magsasaka at mangingisda sa Hacienda Looc
sa Nasugbu, Batangas at Hacienda Dolores sa Porac,
Pampanga na marahas ngayong itinataboy sa ngalan
di umano ng mga proyektong pangkaunlaran ng mga
higanteng korporasyong gaya ng SM Land, Inc. at
Ayala Land.
Samantala, inaprubahan na ng Pangulong Aquino
ang proyektong Clark Green City sa Tarlac na
magtatayo ng malalaking mga pasilidad para sa
rest and recreation ng mga sundalong Amerikano at
inaasahan na di umanong makapag-aakit ng dayuhang
negosyo. Sa pagkalawak-lawak nitong saklaw na 36,000
ektarya, nakatakdang palayasin ng Clark Green City
ang libu-libong magsasaka at katutubong Aeta sa mga
bayan ng Capas at Bamban mula sa kanilang lupa at
pamayanan.
Kung ngayon pa lamang, Mr. Speaker, ay di na
magkamayaw ang mga magbubukid kung saan lilikas
at hahanap ng kabuhayan sa gitna ng walang tigil
na kumbersiyon at pangangamkam ng lupa, paano
pa kaya kung makapagtagumpay ang makasarili at
makadayuhang mga maniobra upang amyendahan ang
ilang probisyon sa ekonomiya ng ating Saligang Batas
na ang isang pangunahing layunin ay bigyan ng buong
laya at layaw ang mga dayuhan na makapag-ari at
pagsamantalahan ang ating mga lupain?
Ang Pilipinong masang anakpawis, partikular ang
mga kababayan nating magsasaka at mga mangingisda,
kung gayon, ay bugbog-sarado at kay lalim na ng
mga sugat. Sa kabila nito, G. Ispiker, mga kapwa
Mambabatas, mayroon pa pong asin na palagiang
kinakaskas sa mga sugat na ito, at ito ay walang iba
kundi ang walang kahihiyang paggamit sa pangalan ng
mga magbubukid sa kapakanan di umano ng mahihirap,
para lamang makapagdambong ng bilyun-bilyong piso
mula sa kaban ng bayan. Lantad na sa buong bayan
ang talamak na kalakaran ng PDAF at DAP, at kung
paanong ginagamit na daluyan ng korupsiyon ang
mga programa sa agrikultura at serbisyong panlipunan
ng mga ahensiyang gaya ng DA, Department of
Agrarian Reform at National Irrigation Authority. Ang

operasyon sa pag-angkat ng bigas ay nagiging literal
na palabigasan ng mga tiwaling opisyal sa National
Food Authority o NFA. Samantala, ang bilyun-bilyong
pondo ng coco levy fund na nasa pag-iingat ng gobyerno
ay lagi ring nanganganib na tuluyang masaid dahil sa
pandarambong.
Kung pagbabatayan ang naging mga pag-aaral
ng Kinatawang ito sa gitna ng mga deliberasyon sa
General Appropriations Bill ng 2015, magpapatuloy
ang ganitong institusyonalisadong pandarambong lalo
pa at batbat ng alokasyong lump sum ang nasabing
panukalang badyet. Nagsilbi rin ang pagsusuri ng
Kinatawang ito sa General Appropriations Bill ng 2015
bilang dagdag na kumpirmasyon sa katotohanang hindi
tumutugon ang kasalukuyang priyoridad, programa
at patakarang pang-ekonomiya at panlipunan ng
pamahalaan sa aktwal na kalagayan, pangangailangan
at kahilingan ng mga magsasaka, mangingisda at iba
pang Pilipinong masang anakpawis.
Ang konklusyong ito, G. Ispiker, mga kapwa
Mambabatas, kasama na ang buhay na mga aral mula sa
palagiang pakikipagkonsultasyon at pakikipamuhay sa
sektor ng api at pinagsasamantalahan, ay makabuluhang
tulak sa Kinatawang ito upang ipagpatuloy ang
tungkuling mapagtibay ang House Bill No. 252,
ang Genuine Agrarian Reform Bill o GARB, na
kasalukuyang nakasalang sa Committee on Agrarian
Reform, lalo pa at ang Comprehensive Agrarian
Reform Program ay malaon nang napatunayang bigo
at ngayon nga ay lipas na at wala na ring batayan para
palawigin pang muli. Napakahalagang seryosong
maharap ngayon ang mga gawain sa pagpapasa ng
isang bagong batas na totoong tutugon sa daantaon nang
pangarap ng magbubukid para sa tunay, makatarungan
at mapagpalayang reporma sa lupa.
Gayundin, G. Ispiker, mga kapwa Mambabatas,
nakaatang sa Kinatawang ito ang isa pang hamon na
maagap na makapagbalangkas ng isang panukalang
batas para sa pambansang industriyalisasyon na
magsisilbing kakambal na haliging batas ng Genuine
Agrarian Reform Bill tungo sa hustisyang panlipunan
at kaunlaran.
Bilang pangwakas, G. Ispiker, mga kapwa
Mambabatas, nais ipaabot ng Kinatawang ito na ang
talumpating ito ay iniaalay ng ANAKPAWIS Party-List
sa dalawang magsasakang Lumad mula sa New Bataan,
Compostela Valley. Ang mag-amang Rolando Dagansan,
43 taon at Juda, 15 taon ay pabalik na sana sa kanilang
dampa mula sa pag-aani ng mais nang paslangin sila
ng mga elemento ng 66th Infantry Battalion, Philippine
Army nito lamang ika-12 ng Oktubre. Tadtad ng bala
at nag-iba na ang hugis ng kanilang katawan. Hindi na
mapagkilanlan ang mukha ng amang si Rolando. Putol
na ang isang braso ng anak na si Juda. Paumanhin sa
ganitong di kaayaayang paglalahad subalit, G. Ispiker,
mga kapwa Mambabatas, ito ang isang eksakto at

matingkad na larawan ng tumitinding atake sa uring
magsasaka na buong-pusong pinaglilingkuran ng
Kinatawang ito ng ANAKPAWIS.
Sa panahon ng kasalukuyang administrasyon
at sa hagupit ng tinatawag na Oplan Bayanihan,
mahigit isandaang magbubukid na ang naging biktima
ng extrajudicial killing. Higit pang umigting ang
militarisasyon sa kanayunan lalo na sa mga lugar ng
organisadong mga magbubukid na nagsusulong ng
makatarungang laban para sa lupa.
Sa isang coverage ng media sa trahedya sa
Compostela Valley, ganito ang sabi ng pamilya
ng mga pinaslang, “Kung sa batas ng aming
mga ninuno, kung nakapatay ka, ganoon din
a n g p a r u s a s a m g a n a k a p a t a y. ” D a g d a g n a
panawagan at babala na naman ito, G. Ispiker,
mga kapwa Mambabatas, upang mapagpasya ng
itigil ng pamahalaan ang militarisasyong Oplan
Bayanihan na sadyang hindi nakatuon sa paglutas
sa ugat ng sigalot sa lipunan kundi lalo lamang
nagiging balakid sa pagkamit sa makatarungan at
pangmatagalang kapayapaan.
Ginoong Ispiker, mga kapwa Mambabatas, sadyang

PRIVILEGE SPEECH OF REP. ILAGAN
REP. ILAGAN. Thank you, Mr. Speaker.
Mr. Speaker, honorable colleagues, today and
in the next six days, farmers all over the country
will observe Peasant Week. The observance of
Peasant Week was institutionalized to honor our
farmers whose toil puts food on our table. The
farmers are the backbone of the nation, so it has
often been said. Unfortunately, we have not treated
this backbone of the nation justly. We have not
given them their due.
Last June 30, the five-year extension for the 20-year
CARP ended. And observably, it ended not with a big
bang but with a whimper. Not a single farmer celebrated
or cried over its end because CARP did not give the
farmers the social justice they deserve. Those who voted
for CARP extension in 2009, who thundered in this hall
that CARP extension is the legacy of the reformism, are
now even eerily silent about its end, as if avoiding the
responsibility to account for the illusion they sowed. As
if avoiding the truth that CARP only transformed the
classical landlord response to the agrarian problem of
this country into an official program that, as in colonial
times, had soaked our farmers with their own blood in
a long violent history of massacres, land grabbing and
injustice.
Last October 16, as part of their preparatory
activities for observing Peasant Week, AMIHAN,
a national federation of peasant women, led an
international fact-finding mission in Hacienda Luisita.
They wanted to determine the situation of the farm
workers, particularly the situation of women farm
workers, who are still fighting for the realization of
the 2012 Supreme Court decision that ruled in their
favor the award of the Hacienda lands. Fast forward to
less than a month from now, or on November 16, the
farm workers of Hacienda Luisita, together with the
peasantry of this land, will observe the 10th year of
the Hacienda Luisita massacre that claimed the lives
of seven farm workers. Sampung taon na, Mr. Speaker,
pero wala pa ring hustisya para sa mga minasaker sa
Hacienda Luisita.
It is sad to note that over two years after the Supreme
Court issued its ruling, the farm workers, instead of
receiving the lands they so justly deserve, are at the
receiving end of more oppression, more harassment,
more coercion, more human rights violations, and a
calibrated use of violence. Two years after the Supreme
Court ruling, it seems that finally owning the lands
which they have fought for through more than 50 years,

is getting farther and farther away from becoming
a reality. Far from being humbled by the Supreme
Court decision, the owners of the Hacienda appear to
have become more arrogant, openly defying the court
decision, and more intent in keeping for themselves,
by hook or by crook, the Hacienda lands and to deny
these from the farm workers. It is as if they are mocking
the Supreme Court and even this Congress, flaunting
the authorities of this land the powers and mantle of
impunity that go when you have a Cojuangco Aquino
as President.
As Representative of Gabriela Women’s Party,
I find interest in the fact-finding mission initiated
by AMIHAN because around half of the 6,212 farm
workers listed by the Department of Agrarian Reform
as beneficiaries of HLI lands are women. A significant
number of these women have worked for decades as
sugar planters and are now in their midlife to senior
years. These women have consistently participated
in production work, first as underpaid farm workers,
and then as community leaders and role models who
initiated the bungkalan land cultivation campaign.
Before the delegates of the fact-finding mission,
these women have denounced the land distribution in
Hacienda Luisita, supposedly in the implementation of
the Supreme Court ruling, as a total sham. They sum up
the whole process as a series of panloloko, pandarahas
at pangangamkam or deception, violence and land
grabbing. According to them, the land distribution
the Department of Agrarian Reform is implementing
in Hacienda Luisita is not based on the principle of
“land-to-the-tiller” of genuine agrarian reform. As
the distribution was effected through the tambiolo
scheme, it is based on the draw of luck. As a result,
many farm workers did not get the land they have
worked on for years. What they got are lands located
in several barangays away. To the women farm workers
of Hacienda Luisita, it is clear that the tambiolo scheme
is more meant to put the farm workers in a situation
where they would eventually sell or lease or abandon the
land. Above all, it legalizes the lease holding claims of
brokers and financiers who have duped the farm workers
into putting up their Certificate of Land Ownership
Award as collateral.
Worse, despite the Supreme Court ruling, vast
agricultural holdings remain under the name of the
Cojuangco-Aquino firms and partners such as the
Tarlac Development Corporation or TADECO, the
Central Azucarera de Tarlac or CAT, and the Luisita
Realty Corporation (LRC), Rizal Commercial Banking
Corporation (RCBC) and the Luisita Industrial Park
Company (LIPCO). The women farm workers of
Hacienda Luisita assert that the Cojuangco-Aquinos
have stashed some more than 2,000 hectares of lands
away from the purview of the Supreme Court ruling.
In fact, the Cojuangco-Aquinos are now in a frenzy of

constructing fences around these stashed properties in
order to stake their unlawful claims.
Today, Mr. Speaker, the barangays of Balete,
Cutcut and Mapalacsiao are surrounded by fences
of barbed wires or cement walls guarded by armed
security personnel. Particularly, in Barangay
Mapalacsiao, the Central Azucarera de Tarlac installed
a barbed wire fence to bar farmers from cultivating
214 hectares of agricultural lands, extending to
adjacent Barangay Parang in Concepcion town.
Over 30 policemen were utilized to assist security
guards in preventing farmers from entering the area.
The Alyansa ng Manggagawang-Bukid sa Asyenda
Luisita or AMBALA’s collective farm hut in the said
area was also destroyed in March 2014. But what
really incensed the women farm workers of Hacienda
Luisita is the impunity the Cojuangco-Aquinos
enjoy in using violence against the farm workers
and in using the law and state security forces to turn
the table against the farm workers. Sila na nga ang
niyuyurakan, hina-harass, dinadahas at inaagawan ng
lupa, sila pa ang kinakasuhan at humaharap ngayon
ng maraming gawa-gawang kaso. Let me cite some
illustrative cases from the fact-finding report:
• In Barangay Balete, around 30 farmer-families
who have tilled portions of a 258-hectare property
since 2005 were violently evicted in a series of attacks
ordered by TADECO from September 2013 to February
2014. More than 20 Balete farmers were issued
eviction notices and charged with unlawful detainer
by TADECO. The unlawful detainer charges are now
either dismissed or reverted to the DAR.
• TADECO is also involved in violent incidents
in Barangay Cutcut last March, where more than 80
families were also barred from tilling portions of a 104hectare property also under TADECO’s name. These 80
farmers were also charged with unlawful detainer and
the charges are now also reverted to the DAR.
• The DAR belatedly issued a Notice of Land
Reform Coverage (NOC) for the “TADECO areas”
on December 17, 2013, but this did not stop TADECO
from fencing the property, burning farmers’ homes
and bulldozing crops. The most violent incident, Mr.
Speaker, occurred a few days before Christmas on
December 21, 2013, with almost a hundred police
and fully-armed Special Weapons and Tactics or
SWAT teams deployed to assist TADECO security in
bulldozing farmers’ crops and homes in Balete. Many
farmers were hurt. Five farmers were mauled, arrested,
detained and charged with several fabricated complaints
by police and TADECO.
• A day after Christmas 2013, AMBALA
immediately filed a motion for the DAR to issue a
cease and desist order against TADECO’s fencing
and earth-moving activities. After several months, the
motion was denied by the DAR. By that time, TADECO

had already completed the fencing of landholdings in
the two barangays.
• On February 8, 2014, President Aquino’s birthday,
TADECO guards continued bulldozing crops in the
TADECO area in Barangay Balete, this time burning
the remaining farm huts in the area. A few days after,
on February 13, the Philippine Export Zone Authority
(PEZA) finally approved to include the TADECO
area in Barangay Balete into the Luisita Industrial
Park–Special Economic Zone.
Because of these incidents, women and children
have experienced trauma, and are in need of psychosocial
services. They are also demanding for the rehabilitation
of victims of human rights violation in Hacienda
Luisita.
Mr. Speaker, distinguished colleagues, dumudulog
sa atin ang mga magsasaka upang ating pakinggan ang
kanilang mga hinaing at nang sila ay ating matulungan.
They are asking this House of the People to do something
about the criminalization of agrarian disputes which the
Cojuangco-Aquinos are using to frustrate their rights
to HLI lands. They are also asking this Congress,
particularly the Committee on Agrarian Reform and
Committee on Human Rights, to investigate the state
of implementation of the Supreme Court decision in the
Hacienda and the human rights violations committed
against the farm workers by state security forces and
the private armies of the Cojuangco-Aquinos.
Mr. Speaker, the backbone of the nation, the
farmers, are waiting for justice. Will we continue to
distance ourselves from this distressing situation and
keep our silence as we ignore the hands that toil and
put food on our table?

Nais kong dalhin sa Kapulungang ito ang tinig
ng mga kababaihang labis na nababahala habang
nananatili ang Visiting Forces Agreement (VFA)
at iba pang makaisang panig na kasunduan katulad
ng Enhanced Defense Cooperation Agreement
(EDCA). Hindi maihihiwalay ang kaugnayan ng
mga military agreements na ito sa isyu ng mga
iba’t ibang social costs lalo na sa karahasan sa
kababaihan.
Ang Representasyong ito, sampu ng kasapian ng
Gabriela National Alliance, Gabriela Women’s Party
at mga kasapi ng chapters ng Gabriela Olongapo City
at Central Luzon, ay nagpunta sa burol ng pinaslang
na si Jennifer Laude upang personal na makiramay
sa kanyang nagluluksang kaanak, sa kanyang kapatid
na si Malou at inang si Julita. Dalawang araw
kaming nagpunta, Oktubre 14 at Oktubre 18. Higit
sa pakikiramay sa hinagpis na mawalan ng anak
at kapatid sa isang brutal na pagpatay, nakikiisa
din kami sa galit at pagkaunsiyami sa maraming
kakulangan sa bahagi ng administrasyong ito ukol
sa kaso ni Jennifer.
Hayaan ninyong banggitin ko ang ilang sumusunod
na punto:
Una, nakalipas na ang mahigit isang linggo
mula nang matagpuang patay si Jennifer, wala pa
ring inilalabas si Pangulong Aquino na personal
at hindi mapapasubaliang policy pronouncement
na papanig sa pagpriprisinta kay Private First
Class Joseph Scott Pemberton, at iba pang
pinaghihinalaang kasangkot na pumatay at
pumaslang sa ating kababayan.
Pangalawa, nananatili si Mr. Pemberton at iba pang
kasangkot sa kaso sa kustodiya ng Estados Unidos
at hindi pa isinasalin sa lokal na otoridad. Tanging
ipinahayag lamang ng mga ahensya sa media ay palipadhanging balak na hihiling ng paglilipat ng kustodiya sa
lokal na otoridad.
Pangatlo, wala pa ring ginagawang totohanang
hakbang at galaw ang mga kinatawan ng Executive na
aktibo, bukas at consistent na pakikipagtalastasan sa

mga naulilang pamilya at abugado para makabahagi
sa mga dokumento at impormasyon kaugnay ng mga
komunikasyon sa pagitan ng kapwa panig ng Pilipinas
at Estados Unidos.
Pang-apat, sa kabila ng nakabimbin pang usapin
sa Korte Suprema ukol sa constitutionality ng EDCA,
nabunyag na na ang mga opisyales na nagpapatupad ng
Visiting Forces Agreement at EDCA, sa katauhan nina
AFP Chief of Staff Gregorio Pio Catapang at US Pacific
Command Commander Admiral Samuel Locklear, na
bahagi ng Mutual Defense Board-Security Engagement
Board, na nagaganap na ang impormal na usapan ukol
sa EDCA.
Pang-lima, matapos katigan ng Palace
spokesperson, Herminio “Sonny” B. Coloma Jr., na
magbibigay ng panibagong tulak ang pagpaslang kay
Jennifer sa pagrerebisa sa VFA, ngayong umaga lang
nag-iba na siya ng posisyon at pumihit na, na hindi
umano kaugnay ang pagpatay na ito sa anumang
ligalidad ng VFA.
Sa bahagi namin, hindi maitatanggi na ang
murder ni Jennifer ay isa na namang larawan ng
bulnarebilidad ng ating mga kababayan lalo na ng
kababaihan na maging biktima ng iba’t ibang anyo
ng karahasan sa kamay ng mga dayuhang sundalo.
Napatunayan na natin ito sa kasaysayan na ang
culture of impunity sa panig ng mga sundalong
sangkot sa iba’t ibang krimen at pang-aabuso ang
siyang higit na umiiral.
Batay sa mga nabanggit, nararapat lamang
ang kolektibong pagkilos ng mga mamamayang
Pilipino kasama na ang Kapulungan ng Kongreso
tungo sa pagkakamit ng katarungan kay Jennifer
Laude, hanggang sa tuluyang maiwaksi ang mga
kasunduang hindi pantay at naglalagay sa ating bansa
at sa kanyang mamamayan sa isang bulnerableng
kalagayan. Higit na mainam kung makapagsasagawa
ng mga on-site public hearings sa Olongapo City ang
Justice Committee at ang VFA Oversight Committee
na may totohanang paglahok ng mga organisasyon
ng mamamayan at apektadong mga komunidad lalo
na ang kaanak ni Jennifer Laude. Sa pinakaultimong
hakbang, dapat nang pabilisin ang pagdinig sa Joint
Resolution No. 17 at House Resolution No. 1572 na
tuluyan nang magpapawalang-bisa sa Visiting Forces
Agreement.
Iyon lamang at magandang hapon po sa ating
lahat.
