Consistency and Reasonableness Statement for 14-REZ-24
In accordance with NCGS § 160A-383, Town Council must approve a Consistency and
Reasonableness Statement with regard to each rezoning case it hears.
Staff Recommendation: Staff recommends that the Town Council approve Option A
or Option B related to consistency and reasonableness of rezoning 14-REZ-24 as
stated below:
Option A (recommended if rezoning 14-REZ-24 is approved):
CONSISTENCY AND REASONABLENESS STATEMENT
14-REZ-24 – Indian Wells Conditional Use Revision
THE TOWN COUNCIL OF THE TOWN OF CARY HEREBY STATES:
Section 1: Rezoning 14-REZ-24 is consistent with the Comprehensive Plan
designation of the property as Medium Density Residential.
Section 2: The Town Council considers the adoption of rezoning 14-REZ-24 to
be reasonable and in the public interest based on the information presented at
the public hearings and by the applicant, and based upon the recommendations
and detailed information developed by staff and/or the Planning & Zoning Board
contained in the staff report, and considering the criteria of Section 3.4.1(E) of
the Town of Cary Land Development Ordinance, because, among other reasons,
the rezoning would not change the current use designation to allow development
of detached dwellings compatible with existing uses in the neighborhood at a
density consistent with the Comprehensive Plan.

14-REZ-24 – Indian Wells Conditional Use Revision
THE TOWN COUNCIL OF THE TOWN OF CARY HEREBY STATES:
Section 1: Rezoning 14-REZ-24 is consistent with the Comprehensive Plan.
Section 2: The Town Council considers the denial of rezoning 14-REZ-24 to be
reasonable and in the public interest based on the information presented at the
public hearings and by the applicant, and based upon the recommendations and
detailed information developed by staff and/or the Planning & Zoning Board
contained in the staff report, and considering the criteria of Section 3.4.1(E) of
the Town of Cary Land Development Ordinance, because, among other reasons,
the proposed rezoning does not correct an error or meet the challenge of some
changing condition, trend, or fact.
