General Information You must be registered to attend this event. Purchasers of a BANK HEIST General Admission Ticket will also receive one White Party Ticket as an additional bonus to attend the White Party Event. The free General Admission Tickets do NOT come with White Party Tickets, which must be purchased separately. The General Admission ticket allows entry for one person to all of the General Sessions and one entry to any contests that may be held as part of the General Assembly. The White Party ticket only allows entry to the White Party. Winners of any contest during this event must be of legal age in the state or province of their residence. Payment If paying for any purchase by credit card, you will be charged immediately upon submission of this Agreement. If paying by cashier’s check, wire transfer, or any other of the Company’s accepted methods of payment, payment in full must be submitted to the Company at the time of purchase. Should you initiate a chargeback with your financial institution after agreeing to these terms and thus entering into a legal contract, you will be subject to collection proceedings for the full amount of the purchase you made plus chargeback fees and damages. You agree to pay all costs incurred to collect such debt including, but not limited to, collection costs, attorneys’ fees, and court costs. By purchasing or acquiring this product, you agree that you will not create, formulate, or contribute to any product or service based on the information contained in this product, including but not limited to classes, seminars, presentations, lectures or on any Global Bank Academy™ website or its affiliate websites, or in e-mails sent to you by Global XTS, LLC. DBA - Global BANK Academy™ BE LIABLE TO CUSTOMER OR ANY OTHER PERSON FOR ANY LOST PROFITS, LOST SAVINGS, LOST DATA, OR SPECIAL, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES, WHETHER ARISING OUT OF OR RELATING TO THIS AGREEMENT OR ANY PRODUCT OR SERVICE FURNISHED OR TO BE FURNISHED UNDER THIS AGREEMENT OR OTHERWISE, EVEN IF Global XTS, LLC. DBA - Global BANK Academy™ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. NOTWITHSTANDING ANYTHING IN THE AGREEMENT TO THE CONTRARY, THE MAXIMUM AGGREGATE MONETARY LIABILITY OF Global XTS, LLC. DBA - Global BANK Academy™ AND ANY OF ITS EMPLOYEES, AGENTS, SUPPLIERS, OR AFFILIATES, UNDER ANY THEORY OF LAW (INCLUDING BREACH OF CONTRACT, TORT, STRICT LIABILITY, AND INFRINGEMENT) SHALL NOT EXCEED A REFUND OF THE PURCHASE PRICE LESS SHIPPING AND HANDLING CHARGES. Dispute Resolution This Agreement is governed by the laws of the State of Arizona, exclusive of its choice of law principles, and the laws of the United States of America, as applicable. Exclusive venue for all disputes arising out of the Agreement shall be in the state or federal courts in Maricopa County, Arizona. Purchaser waives all objections to this venue and agrees not to dispute personal jurisdiction or venue in these courts. Purchaser also agrees that they will not bring or participate in any class action lawsuit against Global XTS, LLC. DBA - Global BANK Academy™. or any of its employees or affiliates. Each of us agrees that we will not bring a claim under the Agreement more than one year after the time that the claim accrued. BANK HEIST – TERMS AND CONDITIONS Page 3 Contract By doing business with Global XTS, LLC. DBA - Global BANK Academy™, Purchaser is entering into a contract with Global XTS, LLC. DBA - Global BANK Academy™ in Maricopa County, Arizona. Purchaser further agrees that the Courts in Maricopa County Arizona have the exclusive jurisdiction and are the exclusive venue to adjudicate any dispute regarding the interpretation or enforcement of this Agreement. Severability If any provision of this Agreement is held to be invalid or unenforceable foe any reason, the remaining provisions will continue to be valid and enforceable. If a court finds that any provision of the Agreement invalid or unenforceable, but by limiting such provision, it would become enforceable, then such provision shall be deemed to be written, construed, and enforced as limited to the least degree necessary to make it enforceable. Notwithstanding the foregoing, in the event of expiration or termination of this Agreement, you will remain liable for your indemnification obligations and other obligations which by their very nature are intended to survive the expiration or termination of this Agreement.
