Dezember 2015 über die Neufestsetzung der Gebühr für eine Recherche internationaler Art Decision of the President of the European Patent Office dated 16 December 2015 revising the fee for an international-type search Décision du Président de l'Office européen des brevets du 16 décembre 2015, portant révision du montant de la taxe pour une recherche de type international Der Präsident des Europäischen Patentamts, The President of the European Patent Office, Le Président de l’Office européen des brevets, gestützt auf Artikel 10 EPÜ, Artikel 3 (1) GebO sowie Artikel 8 der Vereinbarung zwischen der EPO und der WIPO nach dem PCT (ABl. EPA 2007, 617), having regard to Article 10 EPC, Article 3(1) RFees and Article 8 of the Agreement between the EPO and WIPO under the PCT (OJ EPO 2007, 617), vu l’article 10 CBE, l’article 3(1) RRT, ainsi que l’article 8 de l’Accord entre l’OEB et l’OMPI au titre du PCT (JO OEB 2007, 617), beschließt: has decided as follows: décide : Artikel 1 Article 1 Article premier Vorbehaltlich abweichender Vereinbarungen zwischen der Europäischen Patentorganisation und den nationalen Patentbehörden der Vertragsstaaten, wird die Gebühr für eine Recherche internationaler Art wie folgt festgesetzt: Unless different terms have been agreed between the European Patent Organisation and the national patent authorities of the contracting states, the fee for an international-type search shall be as follows: Sous réserve d’accords dérogatoires entre l’Organisation européenne des brevets et les services nationaux de la propriété industrielle des États contractants, la taxe prévue pour une recherche de type international est fixée comme suit : - 1 205 EUR für Patentanmeldungen, in denen keine Priorität beansprucht wird (Erstanmeldungen); - EUR 1 205 for patent applications in which no priority is claimed (first filings); - 1 205 EUR pour les demandes de brevet ne revendiquant aucune priorité (premiers dépôts) ; - 1 890 EUR in allen anderen Fällen. - EUR 1 890 in all other cases. - 1 890 EUR dans tous les autres cas. Artikel 2 Article 2 Article 2 Die Höhe der Gebühren für eine Recherche internationaler Art wie festgesetzt in Abschnitt 2.2 Nr. 1 des Auszugs aus dem Gebührenverzeichnis, der dem Beschluss des Präsidenten des Europäischen Patentamts vom 13. Dezember 2013 (ABl. EPA 2014, A13) beigefügt ist, wird ersetzt durch die in Artikel 1 dieses Beschlusses festgesetzte Summe. The amounts of the fee for an international-type search as laid down in Section 2.2, No. 1 of the extract from the schedule of fees annexed to the decision of the President of the European Patent Office dated 13 December 2013 (OJ EPO 2014, A13) shall be replaced by the amount laid down in Article 1 of this decision. Les montants de la taxe pour une recherche de type international tel que défini à la section 2.2, n°1 de l'extrait du barème des taxes figurant en annexe à la décision du Président de l'Office européen des brevets du 13 décembre 2013 (JO OEB 2014, A13) est remplacé par le montant défini à l'article premier de cette décision. Artikel 3 Article 3 Article 3 Die in Artikel 1 festgesetzten Gebühren sind für Patentanmeldungen, die ab 1. April 2016 eingereicht werden, verbindlich. The amounts of the fee laid down in Article 1 shall apply to patent applications filed on or after 1 April 2016. Les montants de la taxe prévu à l'article premier est applicable aux demandes de brevet déposées à compter du 1er avril 2016. Artikel 4 Article 4 Article 4 Dieser Beschluss tritt am 1.
