１．ＶＳＬ（Very Sensitive List）の復習
ワッセナー協定（ＷＡ）の規制品リストは次の三段階になっています。
ＢＬ（Basic List）；規制品全部を網羅
ＳＬ（Sensitive List）；ＢＬからやや機微(sensitive)な品目を抜粋
ＶＳＬ；ＳＬから特に機微な品目を抜粋
ＢＬのみに掲載のものは、輸出令別表第 1・外為令別表の 5～13 項に掲載され、慣用的に
しばしば「ＢＬ品」と呼ばれます。ＳＬのみに掲載（ＶＳＬ不掲載）のものも 5～13 項に掲
載されますが、更に、告示や提出書類通達の付表の指定対象ともなっていることから「告示
貨物」・「付表技術」とも呼ばれます。（「ＳＬ品」と呼ばれることもある）ＶＳＬ掲載
の「ＶＳＬ品」は、輸出令別表第 1・外為令別表では 15 項に掲載されています。

ところがカテゴリー5-1 に限っては、包含関係が上記「公式」から外れた「ねじれ現象」

２．「ねじれ現象」の検証

5.D.1.a.では、ＶＳＬのみが「本カテゴリー全体」を対象にしています。例えば 5.B.1.該当
装置の設計・製造ソフトウェアは、ＢＬとＳＬの対象ではありませんが、ＶＳＬの対象です。
5.E.1.a.についても同じことがいえます。例えば 5.B.1.該当装置の設計・製造技術はＢＬと
ＳＬの対象ではありませんが、ＶＳＬでは対象になります。
遡って調べたところ、WA では 2008 年から、5.D.1.a.と 5.E.1.a.のＢＬ・ＳＬ記述が現行
の内容に変更されています。ところがＶＳＬは 2007 年版のまま今に至っている。すなわち
当時のＶＳＬの変更忘れが原因であろうと思います。どのように変更するのが適切か、私に
は分かりませんが、手を入れる必要だけは明らかであると結論します。
