The Board noted the status of PIL in wP No.3943212013. The
interim order passed by the Hon'ble High Court was perused and
deliberated.
The letter of Transport Commissioner dated 18.9.2014 requesting for
Government orders from the Department of Ecology & Environment
to implement the following directions issued under Section 3l(A) of
the
Air Act was examined viz.,
1) To ban the use of 2-stroke vehicles within BBMP area.
2) To ban Autorickshaws in CBD of Bangalore in a
phased
manner.
3) To ban the use of more than 15 years old HMVs within
Bangalore citY.
4) To issue necessary notification restricting the sale of fuel in
BBMP area for vehicles not having pollution under control
certificate.

The Board deliberated on the subject and accorded approval to
cancel the tender for procurement
of laboratory equipments which
was initiated during 2012.
The Board also advised that the requirement of laboratory equipment
and the monitoring equipments are to be assessed and proposals be
placed before the Board with probable estimate for procurement.
The Board also emphasized that all the laboratories of the Board are
to be certified and recognized under the Environment (Protection)
Act, 1986 in phased manner.

and around Peenya Industrial Area, Bangalore by

Geophysical Research Institute (NGRI), Hyderabad a GSIR Institute.
As the single source requires exemption under section 4(g) of the
KTTP Act, the Board opined to send the proposal to Government for
getting the exemption. After getting the exemption, work shall be
entrusted to NGRI at a cost not exceeding Rs.3 4.69 lal<hs (Rupees
thirty-four lakhs sixty-nine thousand only) inclusive of all.

Directions issued by the Central Pollution Control Board under
section 18(1)(b) of the water (Prevention and Control of
Pollution) Act, 1974 and the Air (Prevention and Control of
Pollution) Act, 1981 regarding strengthening of monitoring
mechanism for effective compliance in highly polluting
industries.

The Board noted the directions issued by the CPCB for installation
of online monitoring systems for 17 category industries,
CETps,
Common Bio Medical Waste and Hazardous waste facilities by end
of March, 2015. The Chairman explained that, the directions cannot
be implemented uniformly for all industries/sectors as there
are
certain limitations viz. small units not causing significant pollution,
industries recycling the treated effluents completely, the emission
sources not significant, technological limitations
in online
systems,
some industries associations have represented about the difficulties
in implementation, etc. and informed that a letter is being addressed
to CPCB. Further, he informed that the office is also getting ready to
establish facilities for online receipt of data from industries.

Collection of Guarantee money by the Board

The Board deliberated on the subject and considering
the views
expressed by the cAG, NGT and the advice given
by the Legar
Advisory committee of the Board, it is resolved to dispense
with
collection of guarantee money that is being collected duqing
various
circumstances. This decision shall come into effect from the
date
of
issue of Notification.

fee prospectively against the consent application made under the
water/Air Acts, as there is no specific provisions under the said Acts

Re-Constitution of Legal Advisory Committee to advice the
Board with regard to Legal matters/court cases reg.

constitute Legal Advisory Committee comprising of experienced
Advocates. The names of the Advocates shall be obtained from
Advocate General/Law Department, having experience and
knowledge in environmental laws, service matters, RTI matters etc.
