Phoenix Mercury/Arizona Lottery All-Star Experience Promotion Official Rules Eligibility The Phoenix Mercury/Arizona Lottery All-Star Experience Promotion (the “Promotion”), presented by the Arizona Lottery, is open only to those individuals who are persons age twenty-one (21) or older on the date of entry, and who reside within seventy-five (75) miles of US Airways Center. The following individuals are not eligible to participate or win a prize in this Promotion: an employee or officer (or any spouse, child, sibling, or parent residing as a member of the primary household of such employee or officer) of LaneTerralever, Arizona Lottery, Fry’s Food Stores, Mercury Legacy Partners, LLC (the “Mercury”), the Women’s National Basketball Association and its Member Teams, NBA Properties, Inc., Phoenix Arena Development Limited Partnership, and Sports & Entertainment Services, LLC, and each of their respective parents, affiliated companies, subsidiaries, licensees, vendors, distributors, dealers, retailers, agents, printers, sponsors of the Promotion, advertising and promotion agencies and any and all other companies if they are associated with the Promotion (collectively, the “Parties”). How to Play With a purchase of two (2) $10 Arizona Lottery Lucky Life instant scratch tickets (“Qualifying Purchase”) during one (1) retail event at a remote location (“Retail Event”), the entrant will be considered to be a Qualifying Purchaser. Initial Prizes: June 18 Game Tickets. A Qualifying Purchaser at the Retail Event will win a pair of ticketsto attend the Mercury home game on June 18, 2014 (“June 18 Game Tickets”), as follows: • Each pair of June 18 Game Tickets is valid for two (2) admissions to the Phoenix Mercury v. Minnesota Lynx game on Wednesday, June 18, 2014, held at the US Airways Center, with an approximate retail value of two hundred dollars ($200). • The June 18 Game Tickets will be available during the Retail Event on a first-come, first-served basis, and shall be limited to the first four-hundred (400) Qualifying Purchasers. • There is no limit to the number of Lucky Life tickets that may be purchased, but a Qualifying Purchaser is limited to ten (10) pairs of June 18 Game Tickets during the retail event, even if more than ten (10) Qualifying Purchases are made. • There shall be no guarantee that separate pairs of June 18 Game Tickets will provide seating in a particular location or that seating will be contiguous to that provided by other pairs of June 18 Game Tickets. Spin to Win. Each Qualifying Purchase at the Retail Event will entitle a Qualifying Purchaser to spin a prize wheel for a chance to win one (1) of the prizes listed below (“Spin to Win Prizes”), as follows: • • The prize wheel may stop at one of three differently colored sections. Certain prizes will be designated for each colored section; and the participant may choose one (1) of the prizes corresponding to the colored section where the prize wheel stops. There is no limit to the number of Lucky Life tickets that may be purchased, but a Qualifying Purchaser is limited so long as supplies last. , subject to availability and so long as supplies last. There is no limit to the number of Lucky Life tickets that may be purchased, but a Qualifying Purchaser is limited ten (10) Spin to Win Prizes during the retail event, even if more than ten (10) Qualifying Purchases are made. Grand Prize: The first four-hundred (400) Qualifying Purchasers will also receive per each Qualifying Purchase one (1) form (“Entry Form”) to be selected by random drawing to win the top prize (the “Grand Prize), as follows: • The Grand Prize is defined below. • There is no limit to the number of Lucky Life tickets that may be purchased, but there is a limit of ten (10) Entry Forms per Qualifying Purchaser per retail event, even if more than ten (10) Qualifying Purchases are made. • All Promotion entries shall become the property of the Parties and may be used for marketing and solicitation purposes. • The term “winner” applies to all winners, including the Grand Prize winner. The term “Winner” applies only to the Grand Prize winner. Retail Event Location The Promotion begins on Thursday, May 29, 2014 at 4:00 PM, and ends on Thursday, May 29, 2014 at 6:00 PM (“Promotion Period”). Entry into the Promotion is limited to one (1) Retail Event during the Promotion Period as follows: Date Thursday, May 29, 2014 Time 4 – 6 p.m. Location Fry’s Food Store @ Baseline Rd. & 24th St. Total # of June 18 Game Tickets 400 pairs The above date, time, and location are subject to change. Visit www.phoenixmercury.com or www.ArizonaLottery.com for up-to-date event information. Any game tickets not redeemed during a Retail Event may be used for subsequent Retail Events, if applicable. Drawing One (1) Grand Prize Winner shall be randomly drawn from the Entry Forms of the Retail Event. The drawing will be held by the Mercury at the Mercury’ offices in the US Airways Center within forty-eight (48) hours after the close of the Promotion Period. Initial Prizes do not involve a drawing. Prizes The Grand Prize shall consist of two (2) tickets to the 2014 WNBA All-Star game on July 19, 2014 at the US Airways Center in Phoenix, AZ, and two (2) jerseys, one (1) of which will be autographed by Diana Taurasi and one (1) of which will be autographed by Brittney Griner. The Grand Prize has an approximate retail value of five hundred dollars ($500), and consists of only those items listed herein as part of the prize. The Spin to Win Prizes will consist of Arizona Lottery and Mercury promotional items, which may differ from but may include such items as T-shirts, baseball caps, mugs, sun visors, visor clips, tote bags, etc. Taxes and Expenses The winners are responsible for any local, state and federal taxes. Any additional expenses incident to any prize are the responsibility of the winners. For example, travel, lodging, food or beverages related to the Promotion or attendance at games are not included. Odds of Winning Odds of being selected as a Winner depend on the number of eligible entries received during the Retail Event.. Upon making a Qualifying Purchase, winning a pair of June 18 Game Tickets and a Spin to Win prize is a certainty, subject to availability and stated limitations. Notification The Grand Prize Winner will be notified by telephone, or email, if a telephone number is not available. If the Winner does not respond to telephone call or email within twenty-four (24) hours, an alternate Winner will be drawn. The Winner will receive an affidavit, prize claim, and release form, which must be executed and returned to the Phoenix Mercury at 201 E. Jefferson Street, Phoenix, AZ 85004, and must be postmarked (if mailed) or received (if hand-delivered) no later than two (2) business days after the release has been delivered or sent. If the affidavit, prize claim and release form is not received in a timely manner, an alternate Winner will be drawn. All Initial Prize winners will be notified of winning, and will receive any prizes won, during the Retail Event. General Terms: By participating in this Promotion, entrants agree to be bound by these Official Rules. All entrants and winners are solely responsible for the actions of any guests who accompany them to the Retail Event or the Grand Prize event. Entrants without proper address and those who have opted not to be contacted by the Parties for any reason will be excluded from drawings. No prize substitution, cash equivalent, or transfer of prize by any winner in violation of these rules and regulations is permitted. The Parties reserve the right to substitute prizes of equal or greater value. Game tickets are to be used for personal use only and may not be resold or redistributed for profit. Game tickets are subject to availability. If the Game is delayed, postponed or cancelled for any reason, ticket winners will not be reimbursed. The Arizona Lottery and Mercury Promotional prizes and conduct of the Promotion are provided by order of the Arizona Lottery Commission under A.R.S. § 5-554(C) and pursuant to Promotion Profile # 54, as a “Buy X and Get Y Free - Player” Play Style. Should any winner make any false statement in connection with this Promotion, the winner will be required to promptly return to the Parties, upon demand, any prize. The Parties reserve the right, in their sole discretion, to modify these Official Rules without materially affecting the terms and conditions of the Promotion. No modification or amplification, oral or written, with respect to the covenants, conditions and terms herein contained, shall be binding upon the Parties unless embodied in an instrument in writing mutually approved by the Parties. The Parties reserve the right to modify, terminate, or suspend the Promotion, or any part of it, if any viruses, bugs, unauthorized human intervention, fire, flood, earthquake, epidemic, explosion, labor dispute or strike, act of public enemy, equipment failure, riot or civil disturbance, war or other military action, terrorist threat or activity, government order, fraud, technical failures or any other factor beyond the Parties’ reasonable control (a “Force Majeure Event”) impairs the integrity, feasibility or proper functioning of the Promotion, as determined by the Parties in their sole discretion. The Parties reserve the right, in their sole discretion, to disqualify any entrant, winner or designee from participating in any aspect of the Promotion if they deem or suspect that such person has engaged in or has attempted to engage in any of the following: (a) acting in violation of the law or these Official Rules; (b) damaging or tampering with or corrupting the entry process or the operation of the Promotion; (c) participating in unsportsmanlike, inappropriate, uncooperative, disruptive, fraudulent or potentially fraudulent behavior; (d) acting with intent to annoy, abuse, threaten or harass any other person; or (e) participating in any activity deemed to be generally inconsistent with the intended operation of the Promotion. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Parties reserve the right to seek damages from any such person to the fullest extent permitted by law. The Parties’ failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Whether caused by an entrant, by any of the equipment or programming associated with or utilized in this Promotion, or by any technical or human error that may occur in the processing of entries, the Parties are not responsible for inaccurate entry information, which may be the result of: (1) error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries; or (2) lost, misdirected, late, incomplete, illegible or unintelligible entries. The Parties are not responsible for any printing or technical error which may occur in processing, printing or distribution of Promotion materials. Mechanically reproduced entries are not permitted and will be deemed void. Illegible/incomplete entries are void. The Parties make no express or implied warranties of any kind with respect to the safety, appearance, or performance of any prize offered. By participating in the Promotion, each winner hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of winner's name and/or likeness in any and all advertising promotions and other publicity conducted by the Parties, unless prohibited by law. Limitation of Liability By accepting a prize, an entrant, on behalf of himself or herself and his or her heirs and legal representatives, agrees to release the Parties from, and shall hold the Parties harmless against, any liability, loss, claims, injury or damage to property or to person, including death, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prizes or participation in this Promotion, even if caused or contributed to by the negligence of the Parties. Parties are not liable in the event that any portion of the Promotion or prize is canceled due to any Force Majeure Event. Disputes Any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded are governed by Arizona Administrative Code (“A.A.C.”) § R19-3-1008. The decision of the Parties is final. Any decision by the Arizona Lottery Director is a final, appealable agency action to the Office of Administrative Hearings under the procedures of A.A.C. § R2-19-101 through § R2-19-122. Exhaustion of administrative remedies applies. Winner’s List For the name of the Winner, send a hand-printed, self-addressed stamped envelope to “Phoenix Mercury/Arizona Lottery Promotion Winner’s Name,” 201 E. Jefferson St., Phoenix, AZ 85004. Requests for the Winner’s name must be received no later than June 30, 2014.
