YOU ARE CORDIALLY INVITED TO ATTEND A COMPLIMENTARY BUSINESS NETWORKING SESSION ON Date: 8th August 2014 (Friday) Time: 5-7pm Place: IP 101, 51 Bras Basah, Manulife Centre IP AND BUSINESS: UPDATES FROM INDONESIA (CHALLENGES & OPPORTUNITIES) The Amendment of Copyright Law in Indonesia The amendment of Indonesian Law No. 19 of 2002 regarding Copyright (“Indonesian Copyright Law”) is an interesting update to be shared at this networking session, as it provides stronger protection for copyright holder and heavier sanctions for copyright violators. By amending the existing Indonesian Copyright Law, the government is sending a strong message to copyright holders and international communities that the Indonesian government is very serious on copyright protection and combating piracy in Indonesia. Through the amendment of the Indonesian Copyright Law, the government wishes to highlight the following: 1. Improvement on the effectiveness of the implementation of the copyright system, either from the perspective of Directorate General of Intellectual Property Rights (as an institution which assigned to manage the administration of the system), as well as law enforcement institution, public (both the creator and other parties using a system referred to); 2. Harmonization of the legislation with the international developments in the field of copyright, including: a. Improvement of the terminology of the creator/the copyright holder; b. Improvement the terminology for copyright protection based on international copyright convention; and c. The terminology which clearer about copyright, creation, creator, copyright holder, publication, multiplication, communication to the public, distribution to the public, computer program, related rights modified in accordance with the rules of Indonesian Language become related to the copyrights, performers, phonogram, and fixation, broadcasting institution in order to prevent and/or avoiding perception or different interpretation of law. A. YULIANTO NURMANSYAH is one of the founding partners, and the current Managing Partner, of NMA. Prior to establishing NMA, Yulianto worked at leading Indonesian law firms Soemadipradja & Taher, including a boutique Indonesian IP firm K&K Advocates. He has more than 11 years’ experience in the IP field, with a particular interest in software copyright infringement, and IP litigation/enforcement work. He obtained his Bachelor of Law degree from the University of Sriwijaya, Palembang, majoring in Business Law. In 2002, Yulianto completed his Master Degree (LLM program) majoring in IP Law from Murdoch University, Perth, Western Australia. Yulianto is a licensed Advocate and a member of the Indonesian Advocates Association (Peradi) as well as a member of INTA. In 2014, Yuli was recognised by Managing Intellectual Property as one of the 2014 IP Stars. CANDRA DARUSMAN, a national of Indonesia, has previously lived in the former Yugoslavia, Mexico, the former Soviet Union and Switzerland. He first joined WIPO, Geneva, in April 2001, as Consultant; he now holds the position of Deputy Director at the WIPO Office in Singapore. Prior to 2001, he was the General Manager of the Indonesian Collective Management Organization (KCI), a position which he held since the establishment of the organization in 1990. He was also the Secretary General of The Indonesian Musicians Foundation (YAMI). M He is an economist graduate (SE – PhD. candidate) from the Faculty of Economics, University of Indonesia, and from 1982 to 1985 was a researcher, lecturer and served as assistant Professor at the Faculty, specializing on Macroeconomics and Micro economics. From 1986 to1987 he worked as a banker at Citibank and in 1987 he entered into the music production and recording business. From 1987 to 1991 he served as Director to the Indonesian Guild of Composers. From 1994 to 1996 he was appointed a member of the Indonesian National Copyright Council by presidential decree. He served as Director of the Indonesian Musicians Cooperative (KOSMINDO), a small and medium enterprise cooperative with the task of seeking venture capital for artist-entrepreneurs. At the same period Mr Darusman was also an active member of the Anti-Piracy Coalition of the Indonesian copyright industries. Mr Darusman, who speaks bahasa Indonesia, English, Spanish, social French, and is learning Chinese, was previously a musician and is still an active composer. His songs are being performed in Indonesia as well as in neighboring countries. He is now based in Singapore with his wife and third child. USTISIARI PERDANA KUSUMAH, is a Managing Partner of Indonesian IP firm K&K Advocates. He is also a member of Advisory Board of the Association of Intellectual Property Consultants (AKHKI) 2013 - present; member of the Ministry of Law and Human Rights’ Council of Experts for Intellectual Property Rights (Tim Pakar HKI) 2012 - present; Special Advisor on IPR for the Director of Special Economy Crime, Criminal Investigation Division, Indonesian National Police Headquarters 2012-2014; Secretary General, of the Indonesian Anti-Counterfeiting Society (MIAP); Deputy Secretary General of the Indonesian Intellectual Property Society (IIPS); Chairman of the Anti-Counterfeiting committee, Asian Patent Attorneys Association (APAA - Indonesia Chapter); member of International Trademark Association (INTA); member of the Indonesian Bar Association (PERADI); Founder and Secretary of the Indonesian IP Arbitration and Mediation Board (BAM HKI); and member of INTA -Anti Counterfeiting Sub-committee.
