We might paraphrase it this way: “You may not be interested in international events, but they are interested in you.” AIIS members, who are all deeply affected by the dynamics of global events and markets, know how true this statement is. For just one of many current examples, consider the deepening pro-democracy protests gripping Hong Kong. According to the Wall Street Journal, on Monday, September 29, investor fears related to developments in Hong Kong sent the Dow down one percent before recovering later in the day. The markets understand that broader-based economic disruptions are a potential consequence of international political turmoil. At the AIIS, because we know how much our members are affected by them, we seek to closely monitor these developments, and particularly any relevant U.S. Government responses, whether on Capitol Hill, or in the executive branch. We employ an extensive global network of reliable, wellplaced sources and connections to gather the information we need to keep our members informed and up-to-date. We then distill and assess this information in the context of factors such as relevant international legal norms and obligations. As important as all of this is, however, we do not just engage in passive monitoring and analysis activities. We know that global political forces and developments have their own pace. Governmentto-government initiatives like the stalled WTO trade facilitation agreement, and the slowing US-EU free trade negotiations, can and often do get bogged down. Difficulties and complications among governments are not a signal that we should stay on the sidelines, however. We believe the opposite is true—it is because of these complications that we are increasing our engagement, and reaching out more to like-minded partners who share our mission and vision of free and responsible trade in steel. An example is the just-concluded negotiation between the AIIS and the Panama Canal Authority for a joint cooperation agreement to promote cooperative efforts and Panama Canal activities related to trade in steel. AIIS members like the Port of Houston Authority have long recognized the importance of a strategic partnership with the Panama Canal Authority, and now this is value that we will be able to bring to all of our members as well. S. Customs and Border Protection (CBP) issued a GUIDANCE document in August 2014 regarding Post-importation Claims for Preferential Tariff Treatment. The polices set forth in this document implement a revised interpretation of judicial precedents and specify the limited means by which post importation claims for preference can be made. They supersede any previously published guidelines or practices. Preferential tariff treatment is not necessary for most basic steel mill products, which are unconditionally duty free. There are however a number of downstream products, and related products which may be imported by steel traders, which may benefit from these programs. While the most used program, the Generalized System of Preferences or GSP, remains suspended, many other preference programs including free trade agreements continue in effect. Preference claims are normally filed at the time of entry, so long as the importer knows the preference applies and has the necessary documentation to support the claim. In some instances, however, the required information or documents may not be available at the time of entry, but becomes known or provided at a later date. The GUIDANCE document lists the two different groups of preference programs, and the methods by which claims for preference not filed at the time of the original entry can be made. One group of programs includes specific statutory provisions that require claims to be filed under 19 USC 1520 (d), which must be made within one year of the date of entry regardless of liquidation status. The second group of programs does not include any specific statutory provisions. Any post entry preference claims filed under these programs must use either the Post Entry Amendment (PEA) or Post Summary Correction (PSC) procedures. (PSC procedures are required for entries filed through ACE.) All such claims must be filed prior to liquidation and within the applicable timeframes. Filing using the wrong procedure will result in denial of the claim. The GUIDANCE document explains that Protests under 19 USC 1514 cannot be used for the initial filing of post importation claims because the liquidation of an entry “as entered” (without a claim) is not a protestable event. Protests may still be appropriate for related issues, but only where an initial preference claim has been filed in a timely manner.
