Parkordnung Campus Urstein
§ 1 Geltungsbereich
Das Abstellen von Kraftfahrzeugen auf den Parkplätzen P1, P2, P3 und Tiefgarage am
gesamten Gelände des Campus Urstein der Fachhochschule Salzburg GmbH (im weiteren als
FHS bezeichnet) ist nur für Studierende, MitarbeiterInnen, extern Lehrende sowie
BesucherInnen der FHS und nach Maßgabe der jeweils gültigen Parkordnung zulässig. Für
BewohnerInnen des Campus Studierendenheims ist die Benutzung des Parkplatz P3 bis auf
Widerruf zulässig.
Jede/r NutzerIn unterwirft sich mit dem Abstellen seines/ihres Fahrzeuges bzw. durch das
Lösen eines Einfahrtstickets dieser Parkordnung. Die Nutzung der Parkplätze P1-P3 sowie der
Tiefgarage ist für Berechtigte mit der FHS Card möglich. TagesbenutzerInnen müssen an der
Einfahrt ein Parkticket lösen.
§ 2 Nutzungsvertrag
Durch Abstellen des Kraftfahrzeuges bzw. durch das Lösen eines Parktickets am Campus Urstein,
kommt ein Nutzungsvertrag über einen Kfz- Abstellplatz zustande. Bei Ablehnung der in dieser
Parkordnung enthaltenen Bedingungen ist die freie Ausfahrt möglich, wenn sie innerhalb von
30 Minuten nach der Einfahrt erfolgt. Gegenstand des Vertrages ist ausschließlich die Nutzung
der jeweiligen Abstellfläche. Der/Die ParkplatznutzerIn hat das abgestellte Kraftfahrzeug zu
sichern und ordnungsgemäß zu Verschließen. Die Verwahrung bzw. Beaufsichtigung des
Kraftfahrzeuges wird seitens der FHS nicht geschuldet. Der Nutzungsvertrag fällt nicht unter
die Bestimmungen des Mietrechtsgesetzes (MRG).
§ 3 Nutzungsvorschriften
Kraftfahrzeuge sind so abzustellen, dass jeweils nur ein Parkplatz benutzt wird. Die
Benützung ist grundsätzlich nur im Zusammenhang mit der Verrichtung von Tätigkeiten am
Campus Urstein gestattet. Ein Dauerparken sowie eine Exklusivnutzung sind mit Ausnahme
der zugewiesenen Parkplätze für gekennzeichnete FHS Dienstfahrzeuge, der Fahrzeuge der
Hochschulleitung und des Elektrofahrzeuges untersagt. Beim Abstellen des Kraftfahrzeuges auf
den dafür vorgesehenen Rasenwaben und gekennzeichneten Stellflächen in der Tiefgarage
sind die Bodenmarkierungen unbedingt zu beachten.
Das Fahrzeug darf vom/von der ParkplatznutzerIn nur zum Zwecke des Parkens abgestellt
werden.
Verboten sind unter anderem:
• das Abstellen von Fahrzeugen ohne polizeiliches Kennzeichen,
• das Betanken und Waschen von Fahrzeugen,
• die Vornahme von Reparaturen oder Ölwechsel.
Im gesamten Bereich des Campus Urstein (insbesondere Parkplatzflächen, Fußgängerzonen
und Tiefgarage) gelten die Vorschriften der StVO, soweit in dieser Parkordnung nichts
anderes bestimmt ist.
Gekennzeichnete Halte- und Parkverbotszonen wie Zufahrten für Einsatzfahrzeuge,
Behindertenparkplätze, Zufahrten für Zustelldienste zu den FHS Gebäuden sowie
gekennzeichnete Parkplätze für Dienstfahrzeuge und Fahrzeuge der Hochschulleitung der FHS
sind freizuhalten.
Bei Zuwiderhandlung behält sich die FHS vor, eine Unterlassungsaufforderung und
gerichtliche Besitzstörungsklage einzubringen. Die Verfahrenskosten der beauftragten
Anwaltskanzlei für eine Unterlassungsaufforderung betragen ca. € 180,- und sind wie die
deutlich höheren Kosten einer Besitzstörungsklage vom Halter/Fahrzeuglenker zu tragen.

Den Anordnungen des für die Parkplatzflächen zuständigen FHS Personals, oder eines dafür
beauftragten Dienstleisters ist unbedingt Folge zu leisten.
§ 4 Vertragsverletzung und Haftung
Verstöße gegen die behördlichen Vorschriften, Nichtbefolgung der Parkordnung oder der
Anweisungen des Parkplatzaufsichtspersonals berechtigen die FHS zur Untersagung der
weiteren Benutzung der Parkplätze inkl. Tiefgarage am Campus Urstein.
Wenn der/die ParkplatznutzerIn Anlagen und/oder Einrichtungen auf dem Campusgelände
beschädigt, ist er/sie verpflichtet, den verursachten Schaden zu ersetzen, wenn der Schaden
auf sein/ihr sorgfaltswidriges Verhalten zurückzuführen ist.
Darüber hinausgehende Haftungsbestimmungen nach ABGB, EKHG sowie sonstige
gesetzliche Vorschriften bleiben davon unberührt. Im Falle einer Schadenszufügung ist das
zuständige FHS Personal unverzüglich zu verständigen.
Allfällige durch die Parkplatzbenutzung verursachte Schäden an Einrichtungen der FHS sowie
durch die Nutzung verursachte Gefahren (z.B. Ölverlust) sind unverzüglich dem zuständigen
FHS Personal zu melden. Der/Die ParkplatznutzerIn verpflichtet sich, in solchen Fällen die
FHS hinsichtlich aller Ansprüche Dritter schad- und klaglos zu halten. Für Schäden an
Fahrzeugen, die vom für den Parkplatz zuständigen FHS Personal oder sonstigen von
der FHS beauftragten Personen im Zusammenhang mit der Parkraumbewirtschaftung
nachweislich vorsätzlich oder grob fahrlässig verschuldet wurden, wird nur gehaftet, wenn der
Schaden vor Verlassen des Campusgeländes gemeldet wird.
Wegen der großen Zahl der eingestellten Fahrzeuge und der Art der Geschäftsabwicklung ist
eine Einflussnahme der FHS auf das Verhalten Dritter nicht gegeben. Der/Die
ParkplatznutzerIn ist daher für die Sicherung seines/ihres Fahrzeuges selbst verantwortlich. Es
besteht seitens der FHS keine Haftung für Schäden (insbesondere Einbruch, Diebstahl oder
Beschädigungen am KfZ) durch Dritte ungeachtet, ob diese sich befugt oder unbefugt auf dem
Parkplatz oder in der Tiefgarage aufhalten.
§ 5 Nutzungsentgelte
Die Benützung der Abstellflächen am gesamten Gelände des Campus Urstein der
Fachhochschule Salzburg GmbH sowie in der Tiefgarage ist bis auf Widerruf für Studierende,
MitarbeiterInnen und extern Lehrende kostenfrei. Dadurch wird kein Rechtsanspruch für die
Zukunft begründet. Die FHS behält sich die künftige Einhebung eines Entgelts vor. Für
BesucherInnen der FHS gilt der jeweils gültige Tarif und etwaige sonstige Gebühren. Diese
sind dem Aushang an der Einfahrt und am Kassaautomaten zu entnehmen.
BesucherInnen der FHS können nach Bezahlung der Einstellgebühr am Kassaautomaten ausfahren. Ab Bezahlen der Einstellgebühr steht den BesucherInnen für die Abholung seines/ihres
Kraftfahrzeuges bis zum Passieren des Ausfahrtsschrankens eine angemessene Zeit zur
Verfügung (Ausfahrtstoleranz). Bei verspäteter Ausfahrt muss der über den bezahlten
hinausgehende Zeitraum aufgezahlt werden.
§ 6 Verlust oder Beschädigung des Parktickets
Das Parkticket ist sorgfältig und sachgemäß zu verwahren. Die Gefahr der Beschädigung und
des Verlustes trägt der/die BesucherIn.
Sollte durch Beschädigung die Funktion des Parktickets nicht mehr gegeben sein, so berechtigt
dies die FHS zur Verrechnung des entstandenen Aufwandes und der Parkgebühr.
Bei Verlust des Parktickets ist ein Ersatztarif laut Tarifaushang zu bezahlen, außer es kann die
tatsächliche Einstelldauer (Kurzparker) des Fahrzeuges nachgewiesen werden. In diesem Fall
kann zusätzlich eine Bearbeitungsgebühr laut Tarifaushang zu bezahlen sein.
Wird der Bereitschaftsdienst außerhalb der personalbesetzten Zeit aus Gründen, die nicht von
der FHS zu vertreten sind, zur Ein- oder Ausfahrt oder für andere Dienste in Anspruch
genommen, so berechtigt dies die FHS zur Verrechnung des entstandenen Aufwandes.

§ 7 Schließung
Die FHS behält sich jederzeit die Schließung der Parkplatzflächen, der Tiefgarage oder die
Absperrung von Teilen hiervon vor. Ersatzansprüche deswegen sind ausgeschlossen.
§ 8 Sonderbestimmungen für Personen mit Beeinträchtigungen
FHS-Angehörige und BesucherInnen mit Beeinträchtigungen, die im Besitz eines Ausweises
gemäß §29b StVO sind, können auf den hierfür gekennzeichneten Plätzen kostenfrei parken.
Abhängig von den jeweiligen Erfordernissen können weitere Sonderregelungen zur
Anwendung kommen.
§ 9 Video-Bildaufzeichnungen
Die FHS behält sich vor, die Campus Ein- und Ausfahrt sowie Teilbereiche der Garage mit
Videokameras zu überwachen und deren Bilder aufzuzeichnen. Die gespeicherten Daten
werden längstens nach zwei Monaten ab dem Zeitpunkt der Aufzeichnung gelöscht, im
Regelfall erfolgt die Löschung nach 72 Stunden.
§ 10 Sonstige Bestimmungen
Die FHS behält sich die jederzeitige Änderung der Parkordnung vor.
Gerichtsstand für alle Streitigkeiten ist das sachlich zuständige Gericht in der Stadt Salzburg.
§ 11 Inkrafttreten
Die Parkordnung ist Teil der Hausordnung und tritt mit Veröffentlichung auf der FHS-Website
und per Mail an alle FHS-Angehörigen bzw. mit der Anbringung der Parkordnungstafel an der
Einfahrt in Kraft.

Parking Regulations Campus Urstein
§ 1 Area of Application
The parking of vehicles on the parking areas P1, P2, P3 and underground car park on the
entire grounds of Campus Urstein of the Fachhochschule Salzburg GmbH (hereinafter named
UAS) is only permissible for students, employees, external teaching staff and visitors to the
UAS, and only in accordance with the respectively applied Parking Regulations. The residents
of the campus’ student accommodation unit are allowed to use parking area P3 until otherwise
stipulated.
When parking their respective vehicles on the parking area or by obtaining a ticket, each user
automatically subjects himself/herself to these Parking Regulations. Entitled UAS Card holders
are allowed to use the P1-P3 parking areas and the underground car park. Day visitors have to
obtain a parking ticket at the car park entrance.
§ 2 User Contract
Parking a vehicle or obtaining a parking ticket at the Campus Urstein constitutes a user
contract regarding a vehicle parking space. Should anyone entering the parking facility with a
vehicle decide not to accept the applied parking regulations, they may drive through the exit
free of charge, as long as they do so within 30 minutes after entering. The subject matter of the
contract exclusively concerns the use of the respective parking space. The parking facility user
is responsible for securing and locking his or her parked vehicle. The UAS is not responsible
for the safekeeping and supervision of the parked vehicle. The User Contract is not subject to
regulations according to Mietrechtsgesetz (MRG – landlord and tenant law).
§ 3 User Regulations
Each respective vehicle must be parked so that it only occupies the area of one parking space.
As a basic principle, use of the parking facilities is only allowed in conjunction with the
performance of activities at Campus Urstein. With the exception of designated parking spaces
for marked UAS company vehicles, as well as vehicles belonging to the rectorate and university
management and electric vehicles, long-term parking and exclusive use of parking spaces is
not permitted. When parking vehicles on the designated sections of honeycombed grass paving
and on marked parking spaces in the underground car park, one must ensure that the vehicle is
correctly parked within the ground markings.
Parking facility users are only allowed to bring vehicles to or leave them at the parking facilities
for the purpose of parking.
Therefore, among other things, the following is prohibited:
• parking vehicles without valid licence plates,
• filling fuel tanks and washing vehicles,
• performing repairs or oil exchange.
Insofar as these regulations do not stipulate otherwise, the road traffic regulations are applied
to the entire grounds of Campus Urstein (and particularly to parking areas, pedestrian areas

and the underground car park).
Marked stopping restriction zones and no-parking zones, access routes for emergency and
rescue vehicles, parking spaces for the disabled, access routes to allow delivery services to
reach the UAS buildings, as well as marked parking spaces for company vehicles and for
vehicles belonging to the rectorate and university management are to be kept clear.
The UAS reserves the right to file a cease-and-desist order and/or an action of trespass against
those who fail to comply with this regulation. The process costs of the commissioned lawyer’s
office for a cease-and-desist order amounting to approx. € 180.00, as well as the considerably
higher costs of an action of trespass, are to be borne by the vehicle owner/driver.
Instructions given by UAS staff responsible for the parking areas or by a respectively
representative service provider are to be followed.
§ 4 Breach of Contract and Liability
Violations against the official regulations, non-compliance with the parking regulations or with
instructions given by the supervisory staff of the parking facility entitle the UAS to prohibit the
respective user from further using the parking facilities, including the underground car park, at
Campus Urstein.
If a parking facility user causes damage to any facilities or installations on the campus grounds,
he/she is liable to pay compensation for the caused damage, insofar as the damage is
attributable to negligent behaviour on the part of the respective user.
Further liability provisions in accordance with ABGB (Austrian General Civil Code), EKHG
(Railway and Motor Vehicle Liability Act), as well as other legal provisions, remain unaffected.
In the event of any caused damage (damnification), the responsible UAS staff members must
be notified immediately.
If any hazards (e.g. oil loss) should ensue or damages are caused to UAS installations while
using the parking facilities, the responsible UAS staff members must be notified immediately. In
such cases, the responsible parking facility user is obligated to hold the UAS harmless and
indemnify the UAS against all third-party claims. Any damage that has been verifiably caused
to vehicles by UAS staff, or by persons otherwise working for or on behalf of the UAS in
connection with parking facility service and supervision, will only be subject to liability if the
damage is reported before the aggrieved party leaves the campus grounds.
Due to the large number of parked vehicles and the nature of the contractual arrangement, the
UAS is unable to influence the behaviour of third parties. Therefore, each parking facility user is
responsible for locking and securing his/her own vehicle. The UAS does not accept any liability
for damages (particularly with regard to break-ins and/or theft or damage to the vehicle) caused
by third parties, regardless of whether or not the third parties are entitled to be present on the
car park or underground car park or not.
§ 5 User Fees
The use of the parking facilities on the entire grounds of Campus Urstein of Fachhochschule
Salzburg GmbH, including the underground car park, is free of charge for students, employees
and external teaching staff until otherwise stipulated. This does not entitle the user to legal
claims for the future. The UAS reserves the right to possibly charge a fee at any time in the
future. The respectively valid rate and any other relevant charges are applied to visitors of the

UAS. Respective information can be gathered from the notice at the entrance and at the pay
machine.
UAS visitors can drive out of the parking facility after paying the parking fee at the pay machine.
After paying the parking fee, the visitor is provided an appropriate length of time (exit time
tolerance) in which to collect his/her vehicle and drive out through the exit barrier. If the user
should be delayed and exceed the exit time tolerance, the user has to pay an additional sum for
the extended period of time.
§ 6 Loss or Damage to Parking Tickets
The parking ticket is to be kept carefully and in an appropriate manner. The user is responsible
for any risk of loss or damage.
If the ticket should no longer work due to damage, the UAS is entitled to charge both the parking
fee and a fee for the accrued expense.
If the parking ticket should be lost, a compensatory rate is to be paid in accordance with the
rates displayed on the notice, unless the parking duration (short-term parker) of the vehicle can
be proven. In this case, an additional processing fee may be charged in accordance with the
rates displayed on the notice.
If the on-call services are utilized, outside official working hours and for reasons for which the
UAS is not responsible, for purposes of entering or leaving the parking facility or for other
services, the UAS is entitled to charge a fee for the accrued expense.
§ 7 Closure
The UAS reserves the right to close off the parking areas, the underground car park or to close
off sections thereof at any time it chooses. Claims for compensation on this account are
excluded.
§ 8 Special Provisions for Persons with Disabilities
UAS members and visitors with disabilities, who are in possession of an ID card in accordance
with § 29b StVO (Road Traffic Regulations), are entitled to park on the respectively marked
parking spaces, free of charge. Depending on the respective requirements, further special
arrangements may be made for users with disabilities.
§ 9 Video Recordings
The UAS reserves the right to monitor the campus entrance and exit, as well as parts of the
parking facility, with the aid of video cameras and to record and save the respective images.
The saved data is usually deleted 72 hours after the recording or, at the very latest, two months
as from the point in time in which the images were recorded.
§ 10 Other Provisions
The UAS reserves the right to amend the parking regulations at any point in time.
The place of jurisdiction for any disputes that may occur is the District Court of Salzburg.
§ 11 Coming into Effect
The Parking Regulations is a part of the House Rules and come into effect upon publication on

the UAS website and upon notification by e-mail to all UAS members and/or upon mounting of
the parking regulation notice board at the parking facility entrance.
