特許諮問委員会（PPAC）が２０１５年第１回目の委員会を開催２０１５年２月２４日 JETRO NY 知財部今村､丸岡米国特許商標庁（USPTO）は、2015 年第 1 回目となる特許諮問委員会を開催した。本諮問委員会は米国特許法第5条により設立された委員会であり、四半期毎に開催され、USPTO の政策、目標、実績、予算及び手数料を検討し、USPTO 長官に助言を与えるとともに、年次報告書を作成し、商務長官、大統領、上下院司法委員会に提出することをミッションとしている。今次会合では、特許品質の取組みや特許適格性（特許法 101 条）に関する動き、この 1 月から新たに創設された特許品質副局長のポストに就いた、Valencia Martin-Wallace 氏が出席し、USPTO の品質向上に向けた取り組みなどについて紹介した。諮問委員会の資料は以下のリンク参照 http://www.uspto.gov/about-us/events/ppac-quarterly-meeting-february-19-2015 概要 Opening Remarks ・品質向上と顧客対応の充実化は、USPTO における最優先課題と考えている。そのため、新たに特許品質副局長のポストを設けた。新しい品質担当の副局長から、USPTO の取り組みについて紹介。 Quality Initiatives ・品質向上のための 3 本柱（①優良なオフィスアクション、庁内手続、②優良な品質評価、③優良な顧客サービス）のもとで、施策を進めていく。・3 月 25 日、26 日に USPTO で特許品質サミットを開催予定。 101 Update ・審査官に対して、新しいガイダンスと実施例に基づいた研修を実施。・さらなる理解の進化に努めていく。・ガイダンスについては、3 月 16 日までパブリックコメントを募集中。 Operations Update and Discussion ・CPC へのリソース投入により特許審査の FA 期間が少し延びた。・出願人との面接時間は、FA インタビューなどの推進などにより、順調に増加。 International Update and Discussion ・CPC への移行は 1 月 1 日に終了。・グローバルドシエは、審査官向けサービスが 5 月から、一般公衆向けサービスが 12 月から開始される予定。・JPO と協働サーチプロジェクトを開始する。 PTAB Update and Discussion ・査定系審判は、前回報告した 25844 件から 25233 件へと順調に減少。・審判請求から 35 か月以上経過した案件が 400 件強存在している。 OCIO/Patent-End-to-End Update ・審査官用の様々な審査ツール（審査書類管理ツール、補正箇所の表示ツール等）は、 2015 年 1 月にリリース。・サーチシステムの一部機能がリリースされ、第二四半期までに完了予定。・Public Pair からサーチのための分類等のデータやサーチ履歴データのバルクでのダウンロード機能は、今年中にリリース予定。・OA 等審査関連情報の提供は、2016 年度に提供予定。 Finance/Budget Update ・2016 年度の予算は、32 億 700 万ドルを要求しており、250 名の審査官を新規に雇用する予定。また、審判官は 60 名体制を目指す。・産業界から 45 の料金改定に関する提案がなされた。 Legislative Update ・審判請求から 35 か月以上経過した案件が 400 件強存在している。・特許適格性事由（特許法第 101 条）の法改正については、議員スタッフの関心度はそれほど高くないために実現の見通しは低い。 Closing Remarks ・USPTO は、今年 225 年の記念の年。・米国産業界はグローバルな権利保護を求めている。USPTO としては、他国特許庁と協力しながら、特許制度の調和を進めていく必要がある。・バックログも 60 万件を切り、審査待ち期間も着実に減少している。（参考１）諮問委員会メンバー Esther M.
