RISING STARS, TOPKLASSERINGEN IN
INTERNATIONALE PROEVEN!
Het is me een groot genoegen om u opnieuw de catalogus te kunnen
aanbieden van Sale of the Rising Stars, met daarin fantastische
springtalenten. Net als de afgelopen jaren hebben we een selectie van
topmateriaal kunnen samenstellen. Wat u daarvan in de toekomst mag
verwachten zijn prestaties in de internationale topsport. Uit een kleine vijftig
paarden die we de afgelopen jaren hebben verkocht onderscheidt de één na de
ander zich door topklasseringen in internationale proeven.
RISING STARS, HIGH PLACINGS IN
INTERNATIONAL CLASSES!
It is a great pleasure to me to offer you the new catalogue of the Sale of
the Rising Stars, in which you will find fantastic showjumping talents. As
in former years, we managed to compile a selection of top-class material.
What you can expect of these horses in the future are good performances in
the international top sport. One after another of the about fifty horses we sold in
the last couple of years are currently distinguishing themselves by high placings in
international classes.
Volgers van de springsport wereldwijd zullen de meeste van onderstaande namen kennen:
Eurvette O (Douglas) van Schou Absolut horses was met twee overwinningen zeer succesvol in
Lanaken. Chaperon (Quaprice) springt internationaal 1.40m met Kirsten Rikkert. Constance is gekocht
door Milena Pappas en inmiddels succesvol met haar Roemeense trainer Valentin Velea. Deze jonge
Indoctro loopt 2* en jonge-paardenrubrieken tot en met 1.40m. Deen (Phin Phin), verkocht tijdens de
veiling in 2013 springt internationaal jonge-paardenproeven met Willem Greve
Those who follow the showjumping sport world-wide will surely recognize the names mentioned
below: Eurvette O (Douglas) from Schou Absolut horses was very successful with two victories in
Lanaken. Chaperon (Quaprice) is jumping at international 1.40m level under Kirsten Rikkert. Constance
was bought by Milena Pappas and is now successfully performing under her Rumanian trainer Valentin
Velea. This young Indoctro is jumping 2* and young horses classes op to and including 1.40m level. Deen
(Phin Phin), sold at the 2013 auction, is jumping in international young horse classes under Willem Greve
De paarden Crispo (Contendro I) en Embassy M (Warrant) zijn afgelopen jaar op de veiling van Holger Hetzel
verkocht respectievelijk onder de namen Bachelor en Chocolate Chip. Verder hebben veel paarden de weg
naar het buitenland inmiddels gevonden o.a. Fabel (Up to Date) naar Zwitserland, Dominko (Whitaker) als
hunter naar Amerika en Evergreen (Farmer) en Fidelio (Vingino) zijn naar Canada vertrokken.
The horses Crispo (Contendro I) and Embassy M (Warrant) were sold last year at the auction of Holger
Hetzel by the names Bachelor and Chocolate Chip, respectively. Many horses have already found their
way abroad, such as Fabel (Up to Date) to Switserland, Dominko (Whitaker) as a hunter to the USA and
Evergreen (Farmer) and Fidelio (Vingino) left for Canada.
Zeer aansprekend was natuurlijk de veilingtopper van 2013 Castlefield Denver (Quasimodo) die vorig
jaar in Lanaken door Bertram Allen naar de reserve wereldtitel werd gestuurd en vervolgens voor een
vermogen verkocht werd.
Another extremely successful horse was the auction topper of 2013 Castlefield Denver (Quasimodo) which
won the reserve world title last year in Lanaken under Bertram Allen and was then sold for an impressive
sum.
Dame de Fondrière (Vingino) won de vijfjarigen finale in Lummen en werd later via de Expo Talent Sale naar
Amerika verkocht. En ook Eclips (Namelus) was een ‘rising star’ die werd geselecteerd voor de prestigieuze
veiling van de gebroeders Schröder en Jeroen Dubbeldam.
Dame de Fondrière (Vingino) won the finals for 5-yr-olds in Lummen and was later sold to the USA via the
Expo Talent Sale. Also Eclips (Namelus) was a ‘rising star’ that was selected for the prestigious auction of
the Schröder brothers and Jeroen Dubbeldam.
Ook tijdens eerdere edities zijn er paarden geveild die van zich hebben doen horen: Charmeur (v. Quantum)
won de hunterrubriek en de kwalificatie voor vierjarigen in Etten-Leur, Amarenz (v. Niveau) springt
internationaal en Classic (v. Up to Date) werd later voor 110.000 euro verkocht tijdens de Expo Talent Sale
en was met Omer Karaevli in 2012 finalist tijdens het Wereldkampioenschap in Lanaken..
Horses sold at earlier editions of the auction have also made a name for themselves: Charmeur (by

Van de veiling in 2012 is Atlantic (v. Air Jordan), die naar Ierland vertrok, voor veel geld doorverkocht aan
een internationale springruiter. Blanche (v. Cartano) is via Steve Guerdat verkocht aan Simon Bürki en
sprong zeer goed tijdens de Sunshine Tour.
From the auction in 2012 Atlantic (by Air Jordan) left for Ireland and was sold for a very good price to an
international showjumping rider. Blanche (by Cartano) was sold via Steve Guerdat to Simon Bürki and
performed very well in the Sunshine Tour.

paard direct te verzekeren. Kopers die hun paard niet op de dag
van de veiling afrekenen zijn verplicht deze verzekering af te
sluiten.

purchase from the moment of allotment. On the purchase form the
buyer is offered the option to insure the horse immediately. Buyers
that do not pay for their horse on the day of the auction are obliged to

De pas vierjarige G.Acolips maakt het werk voor een trainer en ruiter makkelijk. Hij
imponeert al met zijn verschijning en voortreffelijke galop, springt ondanks zijn jonge
leeftijd al een parcoursje en pakt dit zeer goed aan. Een heel interessant, lichtvoetig
springpaard met een super springtechniek.
The only 4-yr-old G.Acolips makes work easy for a trainer and a rider. He already impresses with
his appearance and excellent canter and in spite of his young age he already jumps a course and
does this very well. A very interesting, light-footed show jumping horse with a superb jumping
technique.
De moeder en grootmoeder van G.Acolips hebben respectievelijk 1.35m en 1.40m
gesprongen en zijn nauw verwant aan de goedgekeurde 1.50m springhengst Lavaletto
(Landgraf) en het internationaal springpaard Cosmos Star (Corrado I). Uit deze familie
komen diverse nationale en internationale springpaarden.
The dam and grandam of G.Acolips jumped at 1.35m and 1.40m level, respectively, and are
closely related to the licensed 1.50m level show jumping stallion Lavaletto (Landgraf) and
the international show jumping horse Cosmos Star (Corrado I). This family produced several
national and international show jumping horses.

De nog maar vierjarige Gilberto heeft wellicht het minste ervaring van alle
veilingpaarden, maar is zeer veelbelovend. De mooi gemodelleerde hengst beweegt
heel lichtvoetig en springt snel van de grond, net als zijn fantastisch springende vader
Baltic VDL.
Moeder Chantal sprong 1.30m en grootmoeder Wennous 1.45m met de Canadese

The only 4-yr-old Gilberto is possibly the least experienced of all the auction horses, but he
is very promising. This handsome stallion has very light-footed movements and has a fast
take-off, just like his fantastically jumping sire Baltic VDL did.
Dam Chantal jumped at 1.30m level and grandam Wennous at 1.45m level under the
Candadian Erynn Ballard. The international 1.45m level show jumping horse Ardenta
VDL (Cardento) ridden by Dominique Roelofsen and the 1.30m level show jumping horse
Violetta (Oramé) ridden by Amy Bell (USA) are half-sisters of Wennous.

Net als Cheeker werd L-Game Boy Z ontdekt op de hengstenkeuring, waar hij alle ogen
op zich vestigde tijdens het vrijspringen. Dit talent laat bijzonder veel kwaliteit zien,
zeer veel reflexen en een uitmuntende voorbeentechniek. Ondanks zijn jonge leeftijd
laat hij zich al heel makkelijk rijden en toont hij veel inzet.
Like Cheeker, L-Game Boy Z was discovered at the stallion selection, where he attracted great
attention during the free jumping. This talent displays a remarkable amount of quality. He has
powerful reflexes and an excellent foreleg technique. In spite of his young age, he is an easy ride
and a very co-operative horse.
L-Game Boy is een halfbroer van het internationaal springpaard Viagra (Hors la Loi II)
met Giulia Bellotti (ITA) en een neefje van het 1.40m springpaard Beat Limit (No Limit)
van Rene Lopez (COL). Vader Last Man Standing raakte in 2008 in de spotlights toen
zijn zoon Le Champ ASK Oldenburger kampioen werd en voor 1,1 miljoen euro werd
geveild.

Wie een beloftevol springpaard zoekt die uit het boekje springt, hoeft niet verder te
zoeken. Flow heeft een sublieme voorbeentechniek, een heel goede achterhandtechniek
en ontwikkelt veel vermogen op de sprong. Doordat ze ook nog eens zeer goed
galloppeert, laat ze haar ruiter volop genieten.
Flow is via moederskant nauw verwant aan het internationaal 1.50m springpaard Pino

bay displays unlimited power. He has relatively little competition experience, but that doesn’t

Felitharin. Daarmee wijst hij op haar gretigheid en inzet op de sprong. Felitharin houdt
van het spelletje en wil maar één ding en dat is naar de overkant van de hindernis. Met
die instelling zal ze nog ver gaan komen in de springsport.
‘Ride her up to a church and she will jump over it’, says Teus van den Brink about Felitharin. He
is referring to her eagerness and co-operation in show jumping. Felitharin loves the game and
only wants one thing and that is to get to the other side of the fence. With that attitude she will
come far in the show jumping sport.

De paarden worden verkocht voetstoots zonder actie of refactie,
in de staat waarin zij zich bij gunning bevinden.
8.
De veilingmeester heeft de bevoegdheid om de volgorde van de
te verkopen paarden te wijzigen of zonder opgave van redenen
personen als bieder/koper te weigeren.
9.
Bieders/kopers worden geacht volledig handelingsbekwaam te
zijn en bij het volle verstand. Iedere bieder/koper wordt geacht
voor zichzelf te hebben gebo­den en is aan zijn bod gehouden
totdat een hoger bod definitief is geaccep­teerd. Een bieder/
koper is naast zijn eventuele lastgever volledig aansprake­lijk
voor het niet nakomen van zijn verplichtingen.
10. Ingeschreven paarden worden bij opbod verkocht.
Stichting Internationaal Stallion Show en/of Internationaal
Concours Noord Nederland Drachten (hierna: ‘ICNN’),
organiseert op zaterdag 24 januari 2015 de Sale of the Rising
Stars (hierna: ‘de veiling’) in het Fries Congrescentrum te
Drachten. De veiling zal plaatsvinden onder toezicht van een
notaris.
11. Het risico ter zake van de paarden, waaronder mede begrepen
doch niet beperkt tot de schade aan en veroorzaakt door
paarden, gaat op het moment van gunning over van de
verkoper op de bieder/koper en wel onmiddellijk. Zolang ICNN
geen algehele betaling van de bieder/koper heeft ontvangen,
blijft de verkoper eigenaar van het paard.
2.
De relatie tussen ICNN en de verkoper is een overeenkomst van
opdracht.
3.
Deze veilingvoorwaarden zijn primair van toepassing op de
relatie tussen ICNN en de verkoper en op de relatie tussen ICNN
en de bieder/koper. Onder verkoper en bieder/koper worden
ook eventuele rechtsopvolgers/rechtsverkrijgers begrepen.
12. De bieder/koper zal onmiddellijk na gunning onder vertoning van
legitimatie een schriftelijke koopovereenkomst tekenen. Mocht
de koopovereenkomst niet onmiddellijk aan de bieder/koper
ter ondertekening worden aangeboden, dan dient hij zich direct
na de veiling dienen te melden bij het secretariaat van ICNN.
4.
ICNN is niet gebonden aan overeenkomsten tussen de verkoper
en de bieder/koper, tenzij in deze veilingvoorwaarden anders is
vermeld.

Alle bedingen in deze veilingvoorwaarden zijn mede gemaakt
ten behoeve van al diegenen die voor of ten behoeve van
ICNN werkzaam zijn of waren. De bepalingen uit deze
veilingvoorwaarden zijn rechtstreeks op deze (rechts)personen
van toepassing, als ware zij zelf ICNN.
De deelneming aan de veiling wordt aangemerkt als
aanvaarding van deze veilingvoorwaarden, met uitsluiting van
eventueel door de deelnemer zelf te hanteren voorwaarden.

13. ICNN heeft gepoogd de catalogus zo nauwkeurig mogelijk
samen te stellen. De informatie over de pedigrees is erop gericht
een indruk te geven van de kwali­teit van de paarden, zonder de
pretentie volledig te zijn en zonder daarmee garanties te geven.
14. Het is de verantwoordelijkheid van de verkoper om de juistheid
van de informa­tie in de catalogus ter zake van het door hem
aangeboden paard te controleren en ICNN vóór de veiling
tijdig en schriftelijk van eventuele fouten of onvolledigheden in
kennis te stellen en daarbij zo gedetailleerd als mogelijk aan
te geven welke wijzi­gingen of aanvullingen dienen te worden
aangebracht.
15. Een afschrift van het veterinair rapport alsmede röntgenfoto’s
kunnen op verzoek zeven dagen voorafgaand aan de veiling en
op de dag van de veiling worden ingezien. De inhoud van het
veterinair rapport, de röntgenfoto’s en eventuele overige door
ICNN verstrekte veterinaire rapportage is bindend voor ICNN,
de verkoper en bieder/koper.
16. De bieders/kopers zijn verplicht om op verzoek van ICNN
informatie te verschaf­fen omtrent hun financiële gegoedheid,
waarbij zij bescheiden aan ICNN dienen over te leggen waaruit
deze gegoedheid blijkt. Door een verzoek tot deelname aan
de veiling machtigen de bieders/kopers ICNN informatie
in te winnen bij derden over hun financiële gegoedheid.

17. ICNN is te allen tijde bevoegd een inschrijving zonder opgave
van redenen niet in behandeling te nemen, danwel paarden
en/of verkopers te weigeren.
18. Alleen de door ICNN erkende adviseurs die voor aanvang
van de veiling bij ICNN schriftelijk hebben opgegeven dat zij
optreden voor één of meer van de bieders/kopers, kunnen
jegens de betreffende verkoper aanspraak maken op provisie.
Deze provisie bedraagt maximaal 4% inclusief BTW over de
koopsom exclusief BTW. Eerst nadat de bieder/koper geheel
aan zijn (beta­lings)verplichtingen heeft voldaan, is de verkoper
de provisie verschuldigd. De verkoper dient de provisie inclusief
BTW op het rekeningnummer van ICNN te voldoen, die voor
doorgeleiding aan de betreffende adviseur zorgdraagt, nadat
de bieder/koper aan al zijn (betalings)verplichtingen heeft
voldaan.
19. De bieder/koper dient op de veiling de koopsom vermeerderd
met 10% opgeld exclusief BTW over de koopsom exclusief BTW,
contant te betalen bij het secretariaat van ICNN, in euro’s
zonder enige korting of inhouding.
20. Indien de bieder/koper hiermee in verzuim is, heeft ICNN de
bevoegdheid het paard onmiddellijk te herveilen, waarbij het
bod van de oorspronkelijke bieder/koper niet weer wordt
aangenomen. De oorspronkelijke bieder/koper is gehouden
het verschil tussen zijn bod en de uiteindelijke lagere koopsom,
alsmede de kosten van herveiling aan ICNN te voldoen. De
bieder/koper heeft geen aanspraken ingeval van een hogere
opbrengst na herveiling.
21. Slechts met voorafgaand schriftelijk verkregen toestemming
van ICNN heeft een bieder/koper het recht giraal te betalen,
waarbij het verschuldigde binnen 7 dagen na de veiling op
het rekeningnummer van ICNN dient te zijn bijge­
schreven.
ICNN verplicht in dat geval de bieder/koper het paard met
onmiddellijke ingang en voor rekening van de bieder/koper
te laten verzekeren bij Hippo Zorg BV, voor een periode van
maximaal één week met een premie van 1,0% van de koopsom,
of maximaal één maand met een premie van 1,5% van de
koopsom, waarbij in het geval van schade aan de bieder/koper
voorts een jaarpremie van 4% van de koopsom in rekening
wordt gebracht. Deze korte samenvatting van de bedoelde
verzekering pretendeert niet volledig te zijn en de bieder/koper
kan hieraan geen rechten ontlenen. De bieder/koper kan de
verzekeringsvoorwaarden op de dag van de veiling verkrijgen
bij het secretariaat van ICNN.
22. ICNN heeft onder andere de bevoegdheid voornoemde
toestemming te onthouden indien de bieder/koper zijn
financiële gegoedheid naar oordeel van ICNN niet aantoont
of geen danwel onvoldoende zekerheid stelt middels een
bankgarantie of anders­zins. ICNN heeft de bevoegdheid de door
haar gegeven toestemming op elk moment weer in te trekken
indien naar haar oordeel twijfel bestaat over de financiële
gegoedheid van de bieder/koper of over de door hem gestelde
zekerheid.
23. Betaling aan enig ander dan ICNN, bevrijdt de verkoper of de
bieder/koper niet van de betalingsverplichtingen jegens ICNN.
24. Indien ICNN niet binnen 7 dagen na de veiling algehele betaling
van de bieder/koper heeft ontvan­gen, is de bieder/koper van
rechtswege in verzuim. De bieder/koper is dan, naast het
overig door hem verschuldigde, aan en ten behoeve van ICNN
een vergoeding verschuldigd ter grootte van 12% inclusief
BTW van de koopsom exclusief BTW. Het totaalbedrag dat
de bieder/koper uit hoofde van zijn betalingsverplichtingen
is verschuldigd, wordt vermeerderd met een rente van 1,5%
per maand, te berekenen vanaf de veiling tot het tijdstip van
algehele betaling.
25. Indien ICNN niet binnen 7 dagen na de veiling algehele betaling
van de bieder/koper heeft ontvan­gen, heeft ICNN voorts de
bevoegdheid zonder ingebrekestelling namens de verkoper en
zonder zijn toestemming de koop als ontbonden te beschouwen.
De verkoper en de bieder/koper blijven in dat geval jegens
ICNN gehouden om aan al hun in deze veilingvoorwaarden
genoemde betalingsverplichtingen te voldoen, voor zover die
een vergoeding ten behoeve van ICNN betreffen.
26. Indien de bieder/koper of de verkoper in verzuim ter zake van
zijn (betalings)verplichtingen, komen alle (buiten)gerechtelijke
kosten die ICNN daar­door maakt voor rekening van de bieder/
koper danwel de verkoper, met een minimumbedrag van
€ 1.000,00 inclusief BTW.
27. Indien en pas nadat aan alle (betalings)verplichtingen jegens
ICNN is voldaan door zowel verkoper als bieder/koper, zal
ICNN uiterlijk 30 dagen daarna het door haar aan de verkoper
verschuldigde voldoen.
28. Verrekening van wederzijdse vorderingen door de verkoper
danwel de bieder/koper ten opzichte van ICNN is uitgesloten.
ICNN is te allen tijde bevoegd wederzijdse vorderingen te
verrekenen.
selecties en keuringen paarden
voor de veiling
29. Alle paarden zijn voorafgaand aan de veiling röntgenologisch
en klinisch onderzocht. Een afschrift van de veterinaire keuring
alsmede de röntgenfoto’s liggen zeven dagen voorafgaand aan
de veiling ter inzage.
afgifte en verwijdering paarden
30. Onmiddellijk na gunning is de bieder/koper verantwoordelijk
voor de zorg van en aansprakelijk voor schade aan het paard
en/of door het paard ontstaan.
31. Indien en pas nadat de bieder/koper volledig aan zijn (betalings)
verplichtingen heeft voldaan, waaronder mede begrepen
betalingsverplichtingen die een vergoeding ten behoeve van
ICNN betreffen, kan de bieder/koper over het paard beschikken,
waarbij hij de benodigde bescheiden zal ontvangen. ICNN is
nimmer verplicht het paard af te geven indien de bieder/koper
niet geheel aan zijn (beta­lings)verplichtingen heeft voldaan.
stalondeugden en gebreken
32. Indien de bieder/koper bij het gekochte paard stalondeugden
constateert, zijnde kribbebijten, weven of luchtzuigen, dan
dient de bieder/koper binnen 7 dagen na de veiling ICNN
hiervan schriftelijk en met een zo gedetailleerd mogelijke
omschrijving van de aard van de stalondeugden op de hoogte
te stellen. Alsdan zal ICNN het paard op een door haar te
bepalen locatie onderbrengen, teneinde het paard door een
door haar aan te wijzen veterinair op de door de bieder/
koper omschreven stalondeugden te laten onderzoeken.
Voornoemde veterinair stelt de aard van de stalondeugden
bindend vast. Indien naar oordeel van die veterinair van de door
de bieder/koper omschreven stalondeugden sprake is, dient
de verkoper de ter zake gemaakte kosten, waaronder mede
voor wat betreft de stalling, het transport en de kosten van
die veterinair, aan ICNN te voldoen. De bieder/koper dient de
bedoelde kosten aan ICNN te voldoen indien naar oordeel van
voornoemde veterinair geen sprake is van de door de bieder/
koper omschreven stalondeugden.
33. Het bepaalde sub 33 geldt eveneens indien de bieder/koper
bij het gekochte paard gebreken, anders dan bedoelde
stalondeugden, constateert.
34. Indien de bieder/koper niet binnen voornoemde termijn van 7
dagen na de veiling op voornoemde wijze melding maakt van
bedoelde stalondeugden of (andere) gebreken en/of indien
voornoemde veterinair de stalondeugden of (andere) gebreken
niet vaststelt, vervalt de bevoegdheid van de bieder/koper de
koop te ontbinden of een beroep te doen op een wilsgebrek.
ontbinding en vernietiging
35. Indien de koop rechtsgeldig door de bieder/koper of de verkoper
wordt ontbonden of vernietigd, blijven de verkoper en de
bieder/koper gehouden aan al hun in deze veilingvoorwaarden
genoemde betalingsverplichtingen jegens ICNN te voldoen,
voor zover die een vergoeding ten behoeve van ICNN betreffen.
De koop kan worden ontbonden of vernietigd met inachtneming
van de ter zake geldende wettelijke bepalingen, voor zover
daarvan in deze veilingvoorwaarden niet rechtsgeldig is
afgeweken.
aansprakelijkheid
36. ICNN is niet aansprakelijk voor de accuratesse van de informatie
in de catalo­gus, de informatie gegeven op het veilingterrein en
de informatie tijdens de veiling. De verkoper vrijwaart ICNN
tegen ieder aanspraak van derden (waaronder mede begrepen
bieders/kopers) wegens schade die voortvloeit uit het niet
voldoen aan de controle- en mededelingsverplichting door
verkoper ter zake van de catalogus als bedoeld sub 14.
37. ICNN is niet aansprakelijk voor de accuratesse van de
informatie in het veterinair rapport (met inbegrip van eventuele
aangehechte (aanvullende) bevindingen), de veterinaire
informatie gegeven op het veilingterrein en de informatie
tijdens de veiling.
38. ICNN is niet aansprakelijk voor schade voorafgaand aan, tijdens
of na afloop van de veiling door en/of aan personen, goederen
of paarden geleden.
39. Ter zake van onder meer de paarden sluit ICNN geen verzekering
af ten behoeve van de verkopers en bieders/kopers. Aangezien
verkopers en bieders/kopers geheel voor eigen rekening en
risico aan de veiling deelnemen, adviseert ICNN hen bedoelde
verzekering zelf af te sluiten.
40. ICNN is niet aansprakelijk voor tekortkomingen van derden.
Hieronder valt tevens de wanbetaling van de bieder/koper.
41. ICNN sluit aansprakelijkheden uit, behoudens ingeval van
opzet of bewuste roekeloosheid van ICNN en/of diegenen die
voor of ten behoeve van ICNN werkzaam zijn of waren.
42. Een ieder die schade toebrengt aan goederen en/of gebouwen
van (danwel gebruikt door) ICNN en/of diegenen die voor ICNN
werkzaam zijn of waren, is aansprakelijk voor deze schade.
43. Zowel de verkopers als de bieders/kopers zijn aansprakelijk
voor alle schade door hen veroorzaakt. Zowel de verkopers als
de bieders/kopers vrijwaren ICNN tegen iedere aanspraak van
derden (waaronder mede begrepen andere verkopers en/of
bieders/kopers, danwel bezoekers) ter zake daarvan.
overig
44. Indien ter zake van de overgang van geveilde paarden naar een
andere lidstaat van de Europese Unie op verzoek van de bieder/
koper wordt gefactureerd met het BTW-nulta­rief, verplicht de
bieder/koper zich alle daartoe noodzake­lijke voorwaarden te
vervullen teneinde een rechtsgeldige intracommunau­
taire
transactie te verwezenlijken.
45. Indien toepassing van het BTW-nultarief door welke
omstandigheid dan ook (achteraf) niet mogelijk blijkt, is de
bieder/koper op dat moment alsnog een bedrag verschuldigd
ter grootte van het bedrag dat verschuldigd zou zijn indien
sprake is van een binnenlandse levering van het desbetreffende
paard. Op verzoek van ICNN is de bieder/koper echter verplicht
vorenbedoeld bedrag onmiddellijk aan ICNN te voldoen. Alsdan
zal terugbetaling daarvan eerst en slechts plaatsvinden indien
de bieder/koper aan de voorwaarden sub 44 heeft voldaan.
De bieder/koper is aansprakelijk en vrijwaart ICNN in ieder
geval voor alle schade die voortvloeit uit het niet voldoen
aan de voorwaarden sub 44. Daarnaast is de bieder/koper
aansprakelijk voor alle (buiten)gerechtelijke kosten die ICNN
maakt, met een minimumbedrag van € 1.000,00 inclusief BTW.
conversie
46. 46. Indien één of meer van de in deze veilingvoorwaarden
genoemde bepalingen niet rechtsgeldig zou(den) zijn of
worden, blijven de overige bepalingen verder rechtsgeldig. In
dat geval treedt in plaats van de bedoelde niet rechtsgeldige
bepaling een nieuwe bepaling, die met de bedoelde oude niet
rechtsgeldige zoveel als mogelijk overeenkomt voor wat betreft
inhoud, bereik en doel daarvan.
geschillen
47. Indien bij een gunning een verschil van mening ontstaat over
de vraag wie het laatste bod heeft gedaan, of indien er andere
moeilijkheden, onduidelijkheden en geschillen ontstaan bij
biedingen en/of over de gunning, is de veilingmees­ter bevoegd
hierover een bindend oordeel uit te spreken. Ingeval van
vorenbedoeld verschil van mening omtrent het laatste bod
is de veilingmeester bevoegd de verkoop bij opbod te doen
continueren.
48. Indien de veilingmeester de notaris verzoekt een oordeel
te vellen, zal de notaris bindend en onherroepelijk voor alle
partijen beslissen. De notaris is gedurende de veiling tevens
bevoegd te oordelen over geschillen van andere aard dan ter
zake van de biedingen en gunningen.
49. De rechtsverhoudingen tussen ICNN, de bieder/koper en de
verkoper worden uitsluitend beheerst door Nederlands recht,
met algehele uitsluiting van het Weens Koopverdrag (CISG).
Geschillen, anders dan die ingevolge het bepaalde sub 47
en 48 aan het oordeel van de veilingmeester of de notaris
zijn onderworpen zullen uitsluitend worden beslecht door de
bevoegde rechter te Amsterdam.

Stichting International Stallion Show and/or Internationaal
Concours Noord Nederland Drachten (hereafter: ‘ICNN’)
is organizing, on Saturday 24 January 2015, the Sale
of the Rising Stars (hereafter: ‘the auction’) in the Fries
Congrescentrum in Drachten. The auction will take place
under the supervision of a notary.
The relationship between ICNN and the vendor is an
agreement by order.
These conditions of auction apply primarily to the relationship
between ICNN and the vendor and the relationship between
ICNN and the bidder/purchaser. By vendor and bidder/
purchase is also meant any legal successor/procurer.
4.
ICNN is not bound to agreements between the vendor and the
bidder/purchaser unless stated otherwise in these conditions
of auction.
5.
All stipulations in these conditions of auction are made for
the benefit of all those who work for and have worked for, or
work and have worked on the behalf of, ICNN. The stipulations
in these conditions of auction apply directly to these (legal)
persons as if they were ICNN.
6.
Participation in the auction will be seen as acceptance of
the conditions of auction, with the exception of contingent
conditions to be handled by the participant him/herself..
7.
The horses will be sold outright, without proceedings or
recompense, in the state in which they were allotted.
8.
The auctioneer retains the right to change the order of sale
of the horses to be sold and, without giving reasons, to deny
participation by persons as bidder/purchasers.
9.
Bidder/purchasers are expected to be fully commercially
competent and to be in full possession of their mental
faculties. Each bidder/purchaser is expected to have bid for
him/herself and will be held to his/her bid until a higher bid
has been definitely accepted. A bidder/purchaser is, along
with his/her eventual principal, fully responsible for nonfulfillment of his/her obligations. A vendor who appears to
have bought his/her own horse back, will also be seen as
bidder/purchaser and all conditions (under which is also
meant all obligations of payment) of auction are considered
applicable concerning bidder/purchasers for the meant
vendor.
10. Registered horses will be, at bidding, sold.
11. Risks concerning the horses by which is meant among other
things, yet not limited to, damage to and damages caused by
horses, are transferred immediately from the vendor to the
bidder/purchaser at the moment allotted. As long as ICNN
has not received full payment from the bidder/purchaser, the
vendor remains owner of the horse.
12. Immediately after allotment, the bidder/purchaser shall,
on production of identification, sign a written agreement of
sale. If the agreement of sale is not immediately offered for
signing to the bidder/purchaser, then he/she must, directly
after the auction, report to the ICNN administration office.

13. ICNN has strived to compile the catalogue as accurately as
possible. Pedigree information aims to give an impression of
the quality of the horses without pretending to be exhaustive
and therefore gives no guarantees.
14. It is the responsibility of the vendor to control the accuracy
of the information in the catalogue that concerns the
horse that he/she has put on offer and to write to ICNN in
good time before the auction in the event of any mistakes
or inadequacies and bring to the notice of such, thereby
acquainting ICNN, in as much detail as possible, with any
changes or additions that are needed.
15. A duplicate of the veterinary report as well as X-rays can be
seen, on request, seven days before the auction and on the
day of the auction itself. The contents of the veterinary report,
the X-rays and any other possible veterinary communications
by the veterinary surgeon as appointed by ICNN, is binding
for ICNN, the vendor and the bidder/purchaser.
16. The bidder/purchasers are obliged, if requested by ICNN,
to supply information concerning the adequacy of their
financial circumstances, in which case they must show
documentation proving the substance of their finances to
ICNN. By requesting participation in the auction, the bidder/
purchasers authorize ICNN in the obtaining of information
concerning their financial circumstances from third parties.
registration, costs and payment
17. ICNN is, at all times, authorized to refuse either horses and/
or vendors for registration without having to state reasons.
18. Only advisors that have been approved by ICNN and
who have made a written application to ICNN before the
commencement of the auction that they will represent one
or more of the bidder/purchasers, can make a claim on the
commission of the vendor. This commission amounts to a
maximum sum of 4% (including VAT) of the purchase price
excluding VAT. Only after the bidder/purchaser has fully
completed his/her obligations of payment is the commission
owed by the vendor. The vendor must pay the commission,
including VAT, onto the bank account number of ICNN who
will ensure the transferal to the adviser concerned after
the bidder/purchase has fulfilled all his/her obligations of
payment.
19. The bidder/purchaser must make cash payment to the
administration office of ICNN at the auction, that is; the purchase
price augmented by 10% excluding VAT on the purchase price,
excluding VAT, in euros, without any discount or deduction.
20. In the event where the bidder/purchaser is deficient herein, ICNN
has the right to immediately re-auction the horse, whereby the
bid of the original bidder/purchaser may no longer be accepted.
The original bidder/purchaser will be obliged to pay the difference
between his/her bid and the final, lower purchase price, as well
as the re-auctioning costs, to ICNN. The bidder/purchaser will
have no claims in the case where there is a higher purchase price
after the re-auction.
25. If ICNN does not receive, from the bidder/purchaser, full
payment within 7 days after the auction, ICNN has the right,
without notification of default, on behalf of the vendor and
without his/her permission, to consider the sale as not binding.
In such cases, the vendor and bidder/purchaser remain
obliged to fulfill all their payment obligations toward ICNN as
laid out in the conditions of auction as far as these concern an
indemnity on behalf of ICNN.
21. Only with permission obtained from ICNN prior to the auction
has a bidder/purchaser the right to pay with a transfer account
whereby he/she must transfer payment within 7 days after the
auction to the bank account number of ICNN. ICNN will, in such
cases, oblige the bidder/purchaser to have the horse insured,
which will take effect immediately and will be at the cost of the
bidder/purchaser, with Hippo Zorg BV. This insurance must be for
a period of a maximum of one week with a premium of 1.0% of the
purchase price or for the maximum of one month with a premium
of 1.5% of the purchase price whereby, in the case of damage,
the bidder/purchaser will be also charged an annual premium
of 4% of the purchase price. This short summary of the aforesaid
insurance is not considered to be complete thus the bidder/
purchaser cannot derive any legal rights from such. The bidder/
purchaser can obtain a copy of the conditions of insurance on the
day of the auction from the administration office of ICNN.
26. If the bidder/purchaser is in default of fulfilling his/her
payment obligations towards ICNN, all judicial and extra
judicial costs accrued by ICNN by these circumstances will be
charged to the bidder/purchaser with a minimum sum of €
1,000.00 including VAT.
22. ICNN also has, amongst other things, the right to withhold
the above-mentioned permission in the event that the bidder/
purchaser’s financial circumstances, according to ICNN’
judgment, by means of bank guarantees or suchlike, do not show,
or fall short of, sufficient means. ICNN has the right to withdraw
its given permission at any time in case doubts arise, in their
opinion, as to the financial adequacy of the bidder/purchaser or
to the securities that have been supplied by him/her.
selection and inspection
of horses for the auction
23. Payment to any other person other than ICNN does not release
the vendor or the bidder/purchaser from payment obligations
toward ICNN.
24. In the event that ICNN has not received the payment in full from
the bidder/purchaser within 7 days after the auction, the bidder/
purchaser is, according to the law, in omission. The bidder/
purchaser is then obliged to pay to ICNN, as well as his/her
other obligations of payment, an indemnity to the sum of 12%
(including VAT) of the purchase price excluding VAT. The total sum
that the bidder/purchaser is indebted from his/her obligation of
payment will be augmented by an interest of 1.5% per month
to be calculated from the time of auction until the time of full
payment.
27. When, and only when, all payment obligations towards
ICNN have been fulfilled by both the vendor and the bidder/
purchaser, will ICNN then complete payment of all money
owed to the vendor within 30 days.
28. Settling of mutual claims by the vendor or the bidder/
purchaser in regard to ICNN is out of the question. ICNN is, at
all times, authorized to settle mutual claims.
29. All horses are, before the auction, clinically tested as well as
having X-rays made. Copies of the veterinary report, as well as
the X-rays, are available for inspection seven days before the
commencement of the auction.
delivery and removal of horses
30. The bidder/purchaser is responsible for the care of the horse
immediately after it has been allotted and liable for any
damage to the horse, or caused by the horse.
31. When, and only when, the bidder/purchaser has fully complied
with his/her obligations of payment, under which is meant
obligations of payment concerning reimbursement to ICNN, can
the bidder/purchaser take delivery of the horse, whereby he/
she will receive the necessary documents. ICNN is not obliged
to deliver the horse in the event that the bidder/purchaser has
not fully complied with his/her payment obligations.
stall vices and deficiencies
32. In the event where a bidder/purchaser detects stall vices in
the horse purchased, whether crib-biting, weaving or windsucking, the bidder/purchaser must, within 7 days after the
auction, notify ICNN in writing with a description in as much
detail as possible of the nature of the stall vice. In such cases,
ICNN will remove the horse to a location of their choice with
the aim to having the horse examined by a veterinary surgeon
assigned by them in order to have the stall vice, as described
by the bidder/purchaser, examined. The veterinary surgeon’s
conclusion of the nature of the stall vice is binding. In the
event where, in the judgment of the veterinary surgeon, there
is such a stall vice as described by the bidder/purchaser, then
the vendor is obliged to pay the costs accrued to ICNN, among
which those concerning the stabling, the transport costs and
the veterinary surgeon’s fee. The bidder/purchaser is obliged
to pay the said costs accrued to ICNN in the case where, in the
judgment of the veterinary surgeon, there is no stall vice as
described by the bidder/purchaser.
33. The specific part, part 33 as above, is also applicable, in the
event where the bidder/purchaser detects defects in the horse
purchased, other than the stall vices mentioned.
34. In the event that the bidder/purchaser, within the term of 7
days after the auction, does not notify ICNN in the manner
as mentioned above, of the stall vices in question or other
defects, and/or in the event where the above-mentioned
veterinary does not establish that there are stall vices or other
defects, the bidder/purchaser does not have the right to annul
the sale nor make a claim of absence of consensus ad idem.
annulment and quashing
35. In the event where the legal sale is annulled or quashed by
the bidder/purchaser, the vendor and the bidder/purchaser
will remain bound to all their obligations of payment toward
ICNN, as mentioned in the conditions of auction, as far as
these concern indemnities to ICNN. The sale can be annulled
or quashed if the valid legal conditions concerned are taken
into consideration, insomuch as they do not deviate in law
from the conditions of auction.
liability
other matters
36. ICNN cannot be held liable for the accuracy of the information
in the catalogue, the information supplied at the auction
grounds or any information made available during the auction.
The vendor indemnifies ICNN from all damages resulting from
inadequacy in the obligations of checking and the obligations
of statements made by the vendor concerning the catalogue
as meant in part 14.
44. In the event where, in the business of transferring the
auctioned horses to another member state of the European
Union, at the request of the bidder/purchaser an invoice is
sent with zero VAT, the bidder/purchaser puts him/herself
under obligation, in the member state of destination, to fulfill
all necessary conditions demanded and in so doing to actualize
an intra-community legal transaction.
37. ICNN cannot be held liable for the accuracy of the information
contained in the veterinary report (including any attached or
supplemental findings), the veterinary information supplied at
the auction grounds or any information made available during
the auction.
38. ICNN cannot be held liable for any damage before, during or
after the auction, sustained or perpetrated by any person,
goods or horses.
39. ICNN will not take out an insurance concerning horses or other
matters, on behalf of the vendors and bidder/purchasers. As
vendors and bidder/purchasers take part in the auction at
their own cost and at their own risk, ICNN advises that they
take out the meant insurance themselves.
40. ICNN is not liable for the failings of third parties; under this
is also classified the case of non-payment by the bidder/
purchaser.
41. ICNN is not liable unless in the case of willful intent or willful
recklessness on the side of ICNN and/or those who work on
behalf of, or have worked on behalf of ICNN.
42. Anyone causing damage to goods and/or buildings (or those
used by) ICNN, and/or those who work for or have worked for
the ICNN are liable for such damage.
43. Both vendors and bidder/purchasers are liable for any
damage they may have perpetrated . Both vendors and
bidder/purchasers indemnify ICNN from any liability toward
third parties by which is meant other vendors and/or bidder/
purchasers or visitors concerning this matter.
45. If application of the VAT zero rating tariff, no matter the
circumstances, appears to be impossible (subsequently), then
the bidder/purchaser, at that time, is still obliged to pay a sum
to the amount that would be owed in the case of a domestic
delivery of the horse concerned. At the request of ICNN the
bidder/purchaser is required to pay the aforementioned sum to
ICNN immediately. In such cases, the refund will be reimbursed
only when and not before, the bidder/purchaser has complied

indemnifies ICNN in all cases from damages that result from
the non-compliance of part 44. Therein the bidder/purchaser
is liable for all judicial and extra judicial costs accrued by ICNN
with a minimum sum of € 1.000,00 including VAT.

46. In the case where one or more of these conditions of auction
are not, or become, no longer lawful, the remaining conditions
remain lawful. In such cases, a new lawful condition will come
in the place of the no longer lawful condition; in which the new
condition will resemble, concerning content, range and aim, as
much as possible the old, no longer lawful, condition.

47. If, at allotment, a difference of opinion arises to the question
as to whom had made the last bid, or in the event that other
difficulties, confusions or disputes arise at the time of bidding
and/or allotment, the auctioneer is authorized to have final say
herein which is binding. In the case where the aforementioned
difference of opinion concerns the last bid made, the auctioneer
is authorized to continue the sale by way of bidding.
48. In the event that the auctioneer calls in the notary to make
judgment, the notary shall, binding and irrevocably, decide for
all parties. During the auction, the notary is also authorized
to make judgment in disputes in other matters than those
regarding that of bidding and allotment.
49. The legal relationship between ICNN and the bidder/purchaser
and the vendor are subject solely to Dutch law, with the
complete exclusion of the Vienna Sales Treaty (CISG). Disputes,
other than those specifically in pursuance of parts 54 and 55,
which are subject to the judgment of the auctioneer and the
notary, shall be settled exclusively by the qualified judge in
Amsterdam.
