ALGEMENE VERKOOPSVOORWAARDEN
1. De facturen en leveringen van Vinopia B.V.B.A. zijn strikt contant betaalbaar bij levering.
2. In geval van wanbetaling zal van rechtswege het factuurbedrag verhoogd worden met
een nalatigheidsintrest van 10 % op jaarbasis, te rekenen van de factuurdatum,
en dit zonder enige ingebrekestelling.
3. Bovendien zal, eveneens zonder voorafgaande ingebrekestelling, een forfaitaire schadevergoeding
verschuldigd zijn, gelijk aan 10 % van het factuurbedrag, met een minimum van € 50,00.
4. In geval van geschillen of betwistingen zullen alleen de rechtbanken, tot wiens rechtsgebied
Schoten behoort, bevoegd zijn.
5. Alle offertes van onze firma zijn vrijblijvend, tenzij schriftelijk het tegendeel wordt
overeengekomen en op voorwaarde dat de offerte werd gedaan door een persoon die gemachtigd is
om onze vennootschap tegenover derden te verbinden.
6. Het ondertekenen van een bestelbon geldt als akkoord over huidige verkoopsvoorwaarden.
7. Behoudens andere vermeldingen geschiedt het vervoer van onze goederen steeds
op risico van de klant.
8. Elke klacht moet ons binnen de 8 dagen na leveringsdatum aangetekend toegezonden worden.
9. Klachten zullen slechts ontvankelijk zijn voor zover de betrokken koopwaar zich nog in dezelfde
toestand als bij de levering bevindt.
10. In geval van gebreken die een weigering van de koopwaar zouden rechtvaardigen,
behoudt onze vennootschap de keuze om ofwel de geweigerde koopwaar te vervangen,
ofwel het reeds betaalde bedrag terug te betalen aan de koper.
In geen geval zal onze vennootschap een schadeloosstelling, zelfs voor onrechtstreekse schade,
verschuldigd zijn
11. De goederen in depot of consignatie geplaatst blijven onherroepelijk eigendom van
Vinopia B.V.B.A., dit tot volledige betaling van de hoofdsom en eventuele bijkomende bedragen.
12. Vinopia B.V.B.A behoudt zich de eigendom van de goederen voor tot
volledige betaling van de prijs. Het risico gaat evenwel reeds over vanaf de levering.
13. De onbetaalde koopwaar moet op het eerste verzoek worden teruggegeven aan
onze vennootschap, behoudens de verplichtingen van de koper om het eventuele
verschil bij te passen, en de reeds ontstane intresten en schadevergoedingen te betalen.
14. Deze prijslijst is geldig tot en met 31 augustus 2014. Ingeval van plotse koerswijzigingen,
verhogingen van accijnzen of BTW, kunnen de prijzen zonder voorafgaande schriftelijke verwittiging
aangepast worden, en dit ook voor de lopende bestellingen.
15. Op alles wat niet expliciet geregeld is in deze algemene voorwaarden is het Belgische recht van
toepassing, De nietigheid van één van de clausules brengt de geldigheid van de andere niet in het gedrang.
