Patents have become a lightning rod for controversy
in the communications and informations technology
sectors. The technical requirements of interoperability and standardization create an environment where
patents may contribute to the constant threat of royalty stacking and monopolization. These issues are
particularly pronounced in determining the remedies
for patent enforcement, where a comparison across
jurisdictions reveals radically different approaches to
mediating the „smartphone wars“.
