Scope of work for Consultancy Services for Architectural drawings, preparation of application form, technical fulfillment and liasoning services for statutory approvals of statutory authorities enrouted in MMPL rerouting Project. 1.0 SCOPE OF WORK Consultancy services and liasoning with statutory bodies for making architectural drawings, preparation of application forms, technical fulfillment for pipeline crossing and laying along National Highways/ Road / River / Canal/ Pipelines/ Water bodies / all Forest areas/Mangroves/ Govt. Lands etc or any other utility for the proposed pipeline from concerned Govt. / Semi – Government, Private/ Autonomous body or any other related Bodies for the utilities/ lands under their jurisdiction falling on the rerouted pipeline alignment as per the specification. SITE VISIT Successful bidder is advised to visit and examine the pipeline route locations and their surrounding, make visit of concern official for inspection or for any official purpose. The costs of visiting the sites of concern shall be at bidders own expenses. Owner/Client's Scope of Supply : Statutory/ License fees payable for application and agreements of various concern ROU and crossings, Govt Lands, Forest Approvals shall be paid by the BPCL on production of Original demand note from the respective Authorities. Cost of land and its stamp duty/Registration charges for SV stations shall be paid by BPCL. All other supply items / services and site visits of concern officials required for completion of the work shall be in bidders’ scope of supply. LIQUIDATED DAMAGES In case of delay in completion of works in schedule period of each NOC for that particular jurisdiction due to the reasons not attributable to BPCL, 10% will be deducted for the effected NOC listed in schedule item. Obtaining Pipeline Crossing and laying in ROU Permissions: Scope of services to be provided shall include Collection of application format for approval / permission from respective State / Central Authorities. Preparation of applications and drawings in the required format. Submitting the application with all supporting documents and drawings to the respective Authorities. Appointing approved certified architect as per requirement of authority granting NOC. Follow-up and expediting the approval process with the respective Authorities. 1 Obtaining approvals / permissions from the respective final Authorities. Arranging signing of agreements if any with concerned Authorities. Obtaining completion certificate from respective Authorities. Procurement of land required for establishment of SV stations and HVO’s in jurisdiction of any of the statutory authority as listed above shall remain in scope of bidder. Arranging pre commissioning NOC’s if sought by any of the authority, shall remain in scope of the bidder and no additional charges towards the same will be admissible. Any other work including intermittent and interlinked NOC required to be carried out in relation to any of the above Forest, Maharashtra Maritime Board, EC clearance, Pollution control board and Railways approval shall be not in the scope of bidder. Obtaining approvals / permissions from appropriate respective State / National and other statutory authorities for the various pipeline crossings en-route and laying in their jurisdiction such as National Highways, State Highways, other Roads, Rail, River, Canal / Drain/Govt. Land Crossings or any other utility crossings etc. BPCL shall provide necessary letters to the State Govt. / Central Govt. / any other authorities as and when necessary. Necessary technical details of the pipeline for making the applications shall be provided by the BPCL. Any statutory and license fees applicable will be paid / reimbursed by the BPCL on production of original demand note / documentary evidence from the concerned authorities. Payment shall be made on lump sum percent wise basis with stage wise approvals after obtaining permissions for all crossings, laying in ROU and any additional crossings shall be the scope of bidding Agencies. It shall be deemed that the Agencies is well acquainted with the nature of work and implications involved in performing the above activities including collection of the required input data from the concerned offices of Revenue Dept. The price offer of the Agencies against this work shall be inclusive of all the expenses to be incurred by them for all the contingencies involved in delivering and discharging the scope of work. Deliverables : Each crossing proposal shall contain following information 1. Correspondence letter 2. Crossing and laying in their jurisdiction permission, payment details 3. Agreement (if any) 4. Land admeasuring approximately a)35x25 near Vashi creek, b) 10x10 , 4 nos across both Ulhas river I&II pipeline crossing as decided by BPCL. (The area can be increased or decreased depending upon the requirement at each location) is to be permanently acquired for setting up the stations with allied facilities. The Agency’s scope of job in case of direct acquisition includes, but is not limited to, the following: a) Assist identification of plot alternatives, survey of underground and above ground utilities and recommendation to BPCL. 3 Remark s b) Obtain the details from the concerned Authorities for set-backs from the main road as per the classification of the roads by R&B/PWD Department. c) Collection of revenue records, establishing correctness of Ownership by search/ revenue records, nil encumbrances etc. d) Demarcation of the land through District Inspector of Land Record (DILR) or any applicable authority in the district/state level and producing the certified copy of the map for said plot. e) Providing BPCL with the latest registered land value in the surrounding area, actual land sale / purchase transactions of the selected plot in the area during last 6 months, if any, details of any acquisition proceedings that have been initiated or proposed to be initiated by local authorities / bodies, trend in the real estate value in the area. f) Expediting subsequent formalities including signing of agreements or deeds if any, to facilitate possession of land by BPCL. g) Assisting BPCL in making statutory fee payment to the authority. h) Obtaining all required approvals/ no objection certificates from concerned authorities like village panchayats, municipalities etc. under whose jurisdiction each plot of land falls, for constructing and setting up stations. i) Obtaining approvals from concerned road authority for laying of approach road to each station from the nearest road. j) Agreement of land for SV station & HVO’s between authority and BPCL. k) The location of aboveground/ underground utilities (if any) in the land acquired for the Stations to be enquired/ discussed with the concerned Departments/ Local Authorities. Proposal for rerouting to avoid interference in the construction work of Pipeline/ Station shall be prepared and arranged as above accordingly. 2.0 TIME PERIOD, PAYMENT TERMS AND DELIVERABLES FOR THE CONTRACT The deliverables shall be, After receipt of original proof of in principal and final approvals. Time Period shall be as mentioned below from the date of LOI for each Jurisdiction as mentioned against each. Apart from this overall time period to obtain all Approval/ NOc’s shall be of 7 months from the date of LOI. For Getting NMMC NOC’s From all the respected depts. For entire pipeline falling in their jurisdiction (All Divisions). (5 months) 1) 10% after submitting approval and getting demand note 2) 40% payment after Agreements signing 3) 50% after getting final NOC work permission. For Getting MIDC NOC’s from all Zones (4 months) 1) 10% after submitting approval and getting demand note 2) 40% payment after Agreements signing 3) 50% after getting final NOC work permission. For Getting NH-4 NOC’s (TMC) (3 months) 1) 10% after submitting approval and getting demand note 2) 40% payment after Agreements signing 3) 50% after getting final NOC work permission. For this payment will be made only 1 % for of the particular item of the schedule of rate. 2) In case any of the sub item of payment term is not operated due to non applicability the % payment shown will be evenly distributed to the remaining sub item. 3)Parties are requested to submit past experience of similar type of job done in past 5 years and shall submit necessary document of PO, completion certificates and related documents along with the bid. 6
