copies of public records that were discussed at a meeting of the Industrial Building Authority
held on February 19, 2014 SpecificaUy the items Contained in Item III E of the February 19
2014 agenda items to include any correspondence that has been transmitted in any manner to
any elected or appointed official or legal counsel representing the Industrial Authority in this
matter.

Constitution of the State of Georgia creating the Paulding County Industrial Building
Authority, there will be introduced at the 2014 session of the Georgia General Assembly

A BILL TO BE ENTITLED
AN ACT
To further define and prescribe the powers and duties of the Paulding County
Industtial Building Authority created by a local amendment of the Constitution of the
State of Georgia of 1945 by an Act and Resolution of the General Assembly of the State
of Georgia 1962-Ga. Laws 1962 page 1176, which local amendment was continued in
existence by and under the authority of Article XI, Section I, Paragraph IV of the
Constitution of the State of Georgia of 1983; to clarify that the purpose of the Authority
is broad in scope and its purpose is to promote and expand for the pUblic good and
welfare industry and trade within Paulding County~ to define that the powers of the
Authority are not limited to the acquisition of buildings or structures suitable and
intended for use as a factory, mill, shop, processing plant, assembly plant or fabricating
plant; to clarify that the list of powers contained in the Amendment creating the Authority
is not exhaustive but merely contains examples of the powers that may be exercised by
the Authority; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA
Section 1: The General Assembly, by law, desires to further define and prescribe
the powers of the Paulding County Industrial Building Authority created by a local
amendment ofthe Constitution of the State of Georgia of 1945 by an Act and Resolution
ofthe General Assembly of the State of Georgia 1962-Ga. Laws 1962 page 1176, which
local amendment was continued in existence by and under the authority of Article XI,
Section I, Paragraph IV of the Constitution of the State of Georgia of 1983, and,
pursuant to the authority given the General Assembly in the Constitutional Amendment
creating the Authority, Section 1 N the powers of the Authority contained in the
Amendment at Section 1 D shall be defined and prescribed to include but not be limited
to the power to:
A) Enter into contracts with public or private entities, including, but not
limited to, contracts for loans to these entities provided these loans further
the purpose of the Authority;
B) Enter into contracts with the Paulding County Airport Authority or
Paulding County, Georgia for the development and improvement of any
airports owned or operated by the Paulding County Airport Authority or
Paulding County, Georgia; and
C) Do any and all acts and things necessary or convenient to accomplish or
further the purpose of the Authority.
Section 2: The powers specified herein and in the Constitutional Amendment
creating the Authority are to be liberally construed so as to allow the Authority to
accomplish its purpose of promoting and expanding for the public good and welfare
industry and trade within Paulding County and reducing unemployment to the greatest
extent possible. The examples of ways to accomplish that purpose such as the power to
"acquire by purchase or gift any building or structure within the limits of Paulding
County, suitable for and intended for use as a factory, mill, shop, processing plant,
assembly plant or fabricating plant" as set forth in Section (5) of the Constitutional
Amendment creating the Authority are merely illustrative and not intended to limit the
broad power vested in the Authority to accomplish its purpose.
Section 3: Nothing contained in this Act shall be construed to limit the powers of
the Authority as set forth in the Constitutional Amendment creating the Authority, nor
shall it be deemed to amend or repeal that Amendment or the requirement that the
Amendment be liberally construed to accomplish the purpose of the Authority_
Section 4: Savings Clause?
