The International Centre for Dispute Resolution® (ICDR) is the standard-bearer
for ground-breaking rules and procedures to ensure a fair, well-managed, and
cost-effective dispute resolution process. The goal of the recently-released
revised and enhanced ICDR Dispute Resolution Procedures was to achieve the
highest level of process efficiency, as well as to codify certain well-established
ICDR administrative practices and introduce several new provisions.
This year’s conference is organized around several mock arbitrations to
demonstrate the key aspects of the revised Rules. Corporate counsel,
arbitrators, and advocates will use a variety of hypothetical scenarios to impart
insight into how the Rules can be used in actual cases.
In addition, the much-anticipated Tertulia roundtable discussion kicks off the
conference with an examination of clause drafting. And the next day, judges
from various jurisdictions in the Americas will share perspectives relating to
their international arbitration proceedings.

Drafting Dispute Resolution Clauses: Practices and Trends
Practitioners around the world rely upon experience, habit, customs, policy, creativity, tradition, and
the ease of “cut and paste” when drafting dispute resolution clauses. Each new clause negotiation and
drafting can lead to drastically different experiences once a dispute arises—the subject of this year’s
popular tertulia roundtable discussions. Conference attendees will split into smaller groups to allow each
attendee to share perspectives. Summaries from each group will be compiled and shared the following
day so that attendees can benefit from all the discussions.

Session I Mock Arbitration of Expedited Procedures
In 2014, the ICDR created its International Expedited Procedures, providing for a sole arbitrator in cases
where no disclosed claim or counterclaim exceeds USD $250,000. Parties initiate these cases by filing
detailed submissions, including all evidence then available. The proceedings continue with an accelerated
schedule towards the award. This mock arbitration demonstrates how the process works. Participants
represent the arbitral institution, the arbitrator, counsel, and clients.

Session II Judicial Involvement in International Arbitration
Participants in the international arbitration process need to understand the key role the judiciary plays in
the fair and efficient execution of their cases. Practitioners often cite the need for the members of their
respective judiciaries to better understand the nuances of an arbitration case and reasoning for potential
judicial involvement. In this session, judges share their insights, observations, and lessons learned as to
how their practices interact with international arbitration.

Session III Mock Arbitration of Article 8, Consolidation
The revised ICDR Rules contain a consolidation provision, which allows a party to request the Administrator
to appoint a consolidation arbitrator. Such administrator has the power to consolidate two or more
arbitrations pending under the Rules, or under the Rules and other arbitration rules administered by
the AAA or ICDR. Participants in this mock session represent the arbitral institution, a consolidation
arbitrator, counsel, and the clients of the cases involved.

Mock Arbitration of Articles 21–22, Document Exchange & Privilege
The revised ICDR Rules incorporate the essence of the ICDR Guidelines for Arbitrators Concerning Exchanges
of Information created in 2008. The tribunal is mandated to manage the exchange of information among
the parties with a view to maintaining efficiency and economy. The Rules provide direction and clarity for
the arbitrator(s) and parties in relation to the exchange of documents—including electronic—and privileged
communications. Article 21 also provides that depositions, interrogatories, and requests to admit generally
are not appropriate procedures for obtaining information in arbitrations under these Rules. This session will
focus on pre-hearing issues. Participants represent the institution, an arbitrator tribunal, counsel, and the clients.

Session V Mock Arbitration of Articles 20 & 23, Conduct of Proceedings and the Hearing
The revised Rules make clear that efficiency is a prime objective of ICDR arbitrations, stating that the
arbitrators and parties shall make every effort to avoid unnecessary delay and expense. The tribunal may
allocate costs, draw adverse inferences, and take such additional steps as necessary to protect the
efficacy and integrity of the arbitration. The tribunal can also provide guidance on witness testimony.
