For Index Universal Life Policies and these Final Expense Products: Immediate Solutions NY; 10‐Pay Solution NY; and Easy Solution NY, GA first‐year overwriting commission is payable on applicable first‐year premiums at the rate of 8.00% of compensable first‐year premium except on policies personally produced by the GA. Due to New York compensation restrictions for GA personally‐produced policies, there is no first‐year overwriting payable on GA personally‐produced policies. Producer First‐Year Commission Rate Unless otherwise specified, the producer first‐year commission rate and the first‐year commission rate on policies personally produced by the GA for all TFLIC life policies is 55.00% of compensable first‐year premium (up to target premium on universal life policies). Expense Reimbursement Allowance (ERA) ERA, based on first‐year compensable premium up to a maximum of 36.00% is payable on TFLIC life policies. The GA must retain 2.00% of ERA on policies written by the producer. The GA may apportion up to 34% of the remaining ERA to the producer in accordance with compensation schedules I through VIII, set forth below. . The 2.00% ERA rate is not payable on policies personally produced by the GA. Due to New York compensation restrictions for GA personally‐produced policies, the maximum ERA payable to the GA on personally‐produced policies is 34.00%. This TFLIC Life Commission Rate Schedule shows commissions and expense reimbursement allowances as a percentage of premiums paid to TFLIC. Where renewal commissions are shown, such renewal commissions are expressed as a percentage of premium received by TFLIC during a given policy year shown on the Schedule. In this Life Commission Rate Schedule the term “producer” means an Independent Producer / IPC / Agent / Non‐Individual Agent / National Account Producer / Institutional Account Producer / Broker / Select Broker / GA Personal Production. References to a payable or credited commission or other compensation and fees are applicable to policies properly coded by TFLIC to the account of the GA for such compensation purposes. Not all policies are authorized for issuance in all jurisdictions. For certain life insurance policies such as universal life policies, whether a premium is a first‐year premium, or a premium in excess of target premium, or a renewal premium, will be determined by factors such as the target premium for the policy, the date on which a premium payment is received by the Company, and compensation limits under New York regulations. Such factors will determine the applicable rate of compensation on premium payments received by the Company. Additional information regarding compensation is set forth in the Compensation section of each TFLIC Universal Life Product Guide. Contact your account manager if additional information is required. Producer Renewal Commission and General Agent Renewal Overwriting Commission: Where commission and other compensation is identified as non‐vested in the Life Commission Rate Schedule, the payment of such non‐vested commission and other compensation is only payable in the instances where the GA or producer contract, under which a policy was placed, remains in full force and effect at the time the premium is paid during the specified non‐vested period. In the case of any policy for which renewal commissions are provided for any year after the tenth policy year such renewal commissions will be payable on the compensable renewal premiums received by TFLIC only during the continuance of the producer contract in full force and effect (also applicable to personal production of the GA). In the case of any policy for which renewal overwriting commissions are provided for any year after the 15th policy year, such renewal overwriting commissions will be payable on the compensable renewal premiums received by TFLIC only during the continuance of the GA contract in full force and effect. Institutional Accounts / National Accounts: Life insurance policies placed under the provisions of a sales agreement between TFLIC and a National or Institutional Account (“Account”) approved by TFLIC may provide for modified commission and other compensation as compared to the commission and compensation provisions set forth in this Schedule. In such instances, the GA approved by TFLIC to accept applications from any such Account shall be compensated on eligible policies transacted through and coded for compensation purposes to the GA in accordance with the compensation schedule in effect between TFLIC and the named Account. Variable Universal Life Products: Since variable universal life products are registered securities products and commissions are paid to registered Broker/Dealers (“B/D”), commission and compensation provisions are set forth in the B/D compensation schedule and are not set forth herein. Permanent Extras & Permanent Flat Extras: Commission and other compensation may be payable on premiums charged for permanent extras or permanent flat extras on policies, which are defined as permanent extra premiums charged for six or more years on term and traditional policies and for nine or more policy years on universal life and variable universal life policies (seven or more years on TransSecure® II NY policies). Six‐Month Rule ‐ Life Policy Replacement: First‐year commission and other compensation is not payable on a new life policy on the same life if the new life policy has an application date within six months before or after the date of lapse or surrender of a then or formerly existing life policy issued by TFLIC or an insurer which is an affiliate of TFLIC unless by Company rule, the payment of first‐year commission and other compensation is specifically allowed. Production Year: Reference to “production year” is made in this Schedule and in other announcements, bulletins, notices and communications issued by the Company from time to time. Such references to production year are generally intended to specify a period of time commencing from the last closing or cut‐off date of the prior production year up to and including the final closing or cut‐off date of the current production year. Policy Rewrites: On policy rewrites (for example, term to term, or universal life [“UL”] to UL), first‐year commission and other first‐year compensation may be payable only on the increased amount of the new policy’s first‐year commissionable premium on term and traditional policies, or on the increase in target premium on universal life policies. First‐year commission and other compensation, when payable, is payable only on new premiums paid into a policy on the difference between the target of the new policy minus the target on the old policy after new premiums have met the target of the original policy. No commission or compensation is payable on rollover funds from one policy to another policy. Therefore, new premiums paid in the first policy year of the new policy up to the amount of the original target will receive renewal compensation and then any additional premium paid in the first year of the new policy may be eligible for first‐year compensation up to the maximum limit. The maximum limit on the amount of first‐year premium that can be compensated at first‐year rates is the amount that the new policy target exceeds the target of the original policy. There will be no first‐year compensation payable in the following situations: No out‐of‐pocket premium is paid in the first year (i.e., only rollover money is received in the first policy year). The target of the new policy is less than or equal to the target of the old policy. Out‐of‐pocket first year premiums paid on the new policy do not exceed the target of the original policy. For term insurance policies, except Trendsetter YRT, full first‐year commission and other compensation is payable for those transactions on which the original term policy has been in a premium‐paying in‐force status for a minimum of nine full policy years; in the instance where the original term policy is a Trendsetter YRT, full first‐year commission is payable on those rewrite transactions where the original Trendsetter YRT policy has been in a premium‐paying in‐force status for a minimum of six full policy years.
